Two years ago, I took a leap of faith and joined Rahat Beri at Blue Ocean IMC to revolutionize legal marketing for law firms. Leaving the security of an in-house position was daunting, with questions swirling in my mind. Would anyone listen to us? Would Managing Partners spare 15 minutes to hear our pitch? How would they recognize our value without signing us on? But all doubts dissipated when we secured our first law firm partnership. The elation of being heard was unparalleled! And who says men can't handle ambitious women? Over the past two years, every law firm that embraced us proved they could handle our ambition. They focused solely on the merit they saw, teaching us a valuable lesson - merit knows no gender! To all the law firms that believed in us, a heartfelt thank you. Our attorney, recently awarded Practitioner of the Year 2024 Anne Nyström and three other women leaders at four law firms were interviewed by Managing IP on how they handle clients' diversity requirements and build strong teams. Anne highlights the importance of building trust-based client relationships through transparency, clear expectations, regular updates, and responsiveness. She also values collaborative teamwork within her firm and with external partners to address clients' needs comprehensively. I could not agree more. Brand rights is a highly specialized field in which clients, particularly SMEs, often lack in-house expertise. Thus, it is crucial to proactively engage with clients, guiding them on how to effectively manage their brand rights. In continuation of our post on "Safe harbor" (see our post https://lnkd.in/dhu5VgdA), we wanted to highlight the recent CAFC ruling in EDWARDS LIFESCIENCES CORPORATION, EDWARDS LIFESCIENCES LLC, v. MERIL LIFE SCIENCES PVT. LTD., MERIL, INC. (see https://lnkd.in/dUE9bQkY). In a 2:1 precedential decision the CAFC ruling provides interpretation of 271(e) with emphasis on the word "solely" - concluding that any act conducted with a view to generate data for obtaining regulatory approval and for submission to the FDA, is exempt from infringement. The facts of the case supported Meril Lifesciences in winning this case. Those are good practices to follow. See also a detailed note from Saki Tohyama on the matter.
