3w'Organisational accountability' has finally become a buzzphrase in Australian privacy law. It has been a long time coming, but it is now here, in belated response to need. Ready availability and widespread deployment of AI and connected smart devices have made collection and use of information about individuals' movements, activities and other characteristics so easy and cheap, and therefore ubiquitous. Responsible organisations need to use new tools to control how and when they collect and use this information. Organisations that don't demonstrably use those tools and control those uses should be prosecuted. We need privacy law reform. However, throughout 2024 Australian Privacy Commissioner Carly Kind has demonstrated that the Commssioner will use the existing law and current enforcement tools to stimulate a new business culture of accountability. Expect plenty more enforcement activity in 2025.
