The U.S. Environmental Protection Agency (EPA) is taking another step to protect people from the health risks posed by exposure to PFAS, or also known as “forever chemicals.” The final rule on PFAS, issued by the EPA on April 10, will designate two widely used PFAS chemicals, perfluorooctanoic acid (PFOA) and perfluorooctanesulfonic acid (PFOS), as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund, and will help ensure that polluters pay to clean up their contamination. The U.S. Environmental Protection Agency (EPA) has taken two major steps to tackle PFAS contamination: issuing final National Primary Drinking Water Regulations and announcing a final rule designating two widely used PFAS chemicals as hazardous substances under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA). These actions follow from EPA’s “PFAS Strategic Roadmap,” which sets out EPA’s “whole-of-agency” approach to addressing PFAS. In accordance with the National Defense Authorization Act of 2020, the U.S. Environmental Protection Agency (EPA) just recently published a 2024 update to its Interim Guidance on the Destruction and Disposal of Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS) and Materials Containing PFAS (PFAS Interim Guidance). The PFAS Interim Guidance does not create any new requirements for the proper destruction or disposal of PFAS, and there are no federal standards for the treatment, destruction and disposal of waste materials that contain only PFAS. Moreover, PFAS alone is not considered a hazardous waste under federal law. (See attached EPA update.) #PFAS #USEPA #HazardousWaste

From GWI's briefing service (11/04/204): Undeterred by a barrage of industry criticism, the US Environmental Protection Agency (EPA) has finalised plans to regulate PFOA and PFOS at 4ppt in drinking water, compromising only on the timeframe by which utilities must comply (extended from 2027 to 2029). The rules retain hazard index classifications for four other per- and polyfluoroalkyl substances when found in mixtures – while further setting individual 10ppt standards for PFHxS, PFNA, and HFPO-DA. Although price escalation pushed the EPA to update its annual compliance cost estimate by 25% to $1.5 billion, the agency fired back at a highly critical American Water Works Association report that put annual costs closer to $3.2 billion. The EPA says AWWA overestimates media disposal costs, as well as “the number of water systems exceeding the maximum contaminant limits.” Nevertheless, the EPA’s insistence that only 6-10% of water systems will be affected has many scratching their heads. Emerging contaminant monitoring data puts this figure closer to 16%.
