If you are CBA/ OBA member, I would like to ask for your support Thursday, February 8th, 2024, at the CBA AGM to vote to pass the CBA Elder Law Sections Resolution “Criminal Code Amendments to Combat Elder Abuse” 24-08-A. The CBA Elder Law Section is bringing this Resolution forward to clarify an older Resolution which states that the CBA will not support any criminal law reform related to elder abuse. The reason the old Resolution was passed in 2011 was to stop any specific offence of ‘elder abuse’ as this may have a negative impact on the victims, therefore, the new Resolution seeks to uphold this criterion but opens the CBA to discuss / consult on other new offences relating to elder abuse. The goal is to pass this new Resolution so that the CBA going forward can participate meaningfully in criminal law reform efforts. To support please register for the AGM meeting. We welcome the decision of The Highland Council to review and update elements of their short-term let policy following consideration of James Findlay KC’s legal opinion as well as their own legal advice. This means that short-term let licence applications that were submitted before the commencement of the STL Control Area on 4th March 2024 will be processed without the Council requiring evidence of planning permission. This development closely follows the third successful legal challenge against The City of Edinburgh Council, with the latest showing their approach to issuing 3-month suspension notices was unlawful. Across the country, legally unsound policies are coming unstuck. It should never has come to this had insights from industry been acted upon. The The Scottish Government's legislation was flawed from the very outset and remains unfit for purpose. However, the Association of Scotland's Self-Caterers stands ready to work with both national and local government to iron out the deficiencies and overcome the outstanding challenges.
