A report published this week by KPMG New Zealand in conjunction with the Human Rights Commission details the financial impact of bullying and harassment in the workplace. In this short article, we discuss employers obligations under the Protected Disclosures (Protection of Whistleblowers) Act 2022. The Act states that serious wrongdoing includes any act, omission, or course of conduct in (or by) any organisation that is a serious risk to the health or safety of any individual. Workplace Investigations…. Are they based on a significant incident that's reported & identified as Inappropriate Professional Conduct (IPC)? ❌ The answer is no, but it's often the case…. initially at the beginning at least. What is more common is once a complaint is made, other complaints surface. These can include subtle actions of misconduct. Things like ✖️being ignored in the workplace ✖️not being provided with the same opportunities as peers ✖️being ambushed in meetings or meetings with hidden agendas ….. subtleties that seem too silly for staff to report but have negative impact. More often than not, staff look for employment opportunities elsewhere & the behaviour goes unchecked & continues. Workplace investigations provide organisations insight into the real impact of these negative interactions & allow them to make informed decisions moving forward. When conducted by an external investigator, Kathryn & I find that staff are usually open & honest in their responses with a reduced fear of reprisal.
