Happy Belated 70th Birthday present to the Landlord and Tenant Act 1954, which came into force 1 October 1954. The provisions in Part II, LTA 1954 play an important role in managing the relationship between commercial landlords and tenants. With The Law Commission’s review just round the corner (18 November 2024). This should hopefully provide an opportunity to address some of the issues and uncertainties surrounding the current law and to align LTA 1954 more closely with modern commercial practices and expectations. Unsurprisingly, a lot has changed in this time and this Act needs a refresh to keep it relevant with the shorter lease terms being preferred. One change could be to allow notices to be served and signed electronically speeding up the whole process and keeping up with the modern way of life. IS THE FARE ACT FAIR TO LANDLORDS? The Fairness in Apartment Rental Expenses Act (FARE) is a new bill just passed by the New York City Council that addresses rental broker fees. The law prohibits rental brokers hired by landlords from charging fees to tenants. Previously, NYC tenants typically paid brokers 15% of annual rent when signing a lease. According to Council member Chi Ossé, who sponsored the bill, the legislation aims to reduce upfront costs for tenants and provide tenants with more negotiating power with landlords.
