Public Policy Exception to enforcement of foreign awards , a topic dear to me as it was my Master Thesis. I always think about the pro arbitration mess, it should be pro justice approach instead . A deep down analysis of DMRC v Dampel might reveal, if the award resulted in serious injustice due to the so called pro arbitration approach? What would have been the result if DMRC v Dampel was adjudicated in court instead of Arbitration? At the end the award has to be suffered by general public as it is against government entities. If Delhi metro assets were attached to fulfill the award and if the metro stops for few hours or a day, what would have been the impact on the metro users.
