This week a Colorado #cannabis company entered into a consent decree with the EEOC to resolve a disability discrimination case. The case provides an opportunity for me to make my routine reminder to everyone in the cannabis industry that your business must comply with federal employment laws. This was not a case where the employer did not know that the employee had a medical issue. The record shows that the employee was very transparent about her disability and how it would impact her work from the moment she was hired. There were so many opportunities for this employer to consult with experienced employment counsel, and if they had, this whole thing could have been avoided. While it's an expensive lesson for the company, it's a great example for everyone else to learn from the employer's mistake here. Beyond the usual lesson (call/get employment counsel!) the settlement here is also an example of how hurt feelings play a role in employment cases in a way that they do not in other business disputes. The employer here agreed to pay $95,000 to resolve this matter, with $60,000 of that allocated to emotional distress damages. However, I suspect that number could have been higher but for a interesting aspect of the settlement. As part of the settlement the employer agreed to issue a formal, public apology to the former employee. I have had more than one matter get stuck in negotiations over dollars, only to learn - often through a skilled mediator - that what the plaintiff needs to move on is some acknowledgement by the employer about what happened. Apologies are often avoided in litigation for fear of inviting more liability, but under the right circumstances a genuine apology can contribute meaningfully to getting a settlement agreement over the line. The takeaway here is call your #employment counsel to make sure you have policies and trainings in place to avoid repeating this employer's mistakes. #cannabislaw #employmentlaw

🌟 **Reflecting on Pro Bono Advocacy: A Lesson Learned** 🌟 Recently, I was faced with a challenging pro bono case that has prompted some deep reflection. A few days ago, I received a call from a colleague regarding a bail matter. It involved a young man who had been accused in an NDPS case. Allegedly, the young man had been falsely accused in the NDPS matter by a girl who used to run a tea stall. The 19-year-old frequented the stall, and a relationship ensued. Eventually, the girl, who allegedly sold marijuana to some customers, accused the young man of being involved in drug peddling. The situation seemed clear-cut at first glance - a case of injustice and false accusations. I worked tirelessly for bail, moved by the young man's mother's tearful plea, claiming her son's innocence and his pivotal role as the family's breadwinner and secured it on last Thursday. However, as I delved deeper into the case, visiting the locality and speaking with locals, I uncovered unsettling truths. It turned out that the young man did have a history of involvement in marijuana sales, though he had managed to evade detection until now and had no case registered against him. Confronted with this reality, I had a candid conversation with the client's mother, who initially denied the allegations but eventually confessed to her son's involvement in drug peddling and consumption. This revelation has left me grappling with the complexities of pro bono work and the ethical dilemmas it can entail. While my intention was to offer assistance to someone in need, I find myself questioning whether I've truly served the cause of justice in this instance. This experience serves as a valuable reminder of the importance of thorough due diligence and the need to navigate pro bono advocacy with a keen awareness of the nuances involved. It's a humbling lesson learned, and one that will undoubtedly inform my approach to future cases. #ProBono #LegalAdvocacy #EthicalDilemmas #Justice #Reflections
