Sarah Joseph makes a very powerful argument. But I am not convinced that the social media ban is disproportionate. We have to ask: does the ban show disregard or contempt to children’s right to political communication? And it is not obvious that it does. Social media is not the only way in which teenagers can be informed about politics. In fact, it is often a poor and superficial way to do so. Nor is it the only means through which teenagers can campaign about political issues. They can set up websites and use other online resources. The harm to children’s mental health is a given. By contrast, the harm to their freedom to political communication is not. The likely effect of a ban is that teenagers’ political engagement will simply change location, not diminish. Sarah is right that a lesser restrictive alternative is available: platforms can introduce better safeguards to prevent harm. But it seems unlikely at the moment that platforms will implement such safeguards effectively, given that there is a huge financial incentive for them not to do so.
