This is captured from a video that shows the operator back over the pedestrian and then drag the pedestrian for ten seconds or so. At about ten seconds, the backhoe operator pulls forward and the pedestrian is dislodged from beneath the backhoe. I do not know the condition of the pedestrian, but the backhoe operator seemed pretty oblivious to what was happening. Now the pedestrian is not without blame- as is normal in our society, their focus was on their phone and not their surroundings, they were outside the crosswalk, and they failed to notice the big, noisy backhoe (though it apparently was NYC, so maybe the noise was a bit hard to hear). However, this is the reason spotters are used with heavy equipment. By the very nature of most heavy equipment, there are massive blind spots and challenges for the operator to see what is around the machine and in the path of travel. Next time you have a chance to get into the operator's station of a piece of heavy equipment climb in and look around. Now add the noise of the engine and the motion of the machine (even closed ROPS are noisy inside) and it is an environment that makes it hard to see and hear what is happening around you. This is why spotters are crucially important. A while back I was asked to help a client who had a fatality when an employee got between the front wheel and the body of a four wheel loader. The operator and crew had just finished some cleanup and for unknown reasons one of the crew entered that area and, without a spotter, the operator could not see him and crushed him when he simply turned the wheels. OSHA did not issue a citation for the lack of a spotter, but one could have been issued and difficult to defend if it were. I think the only thing that saved the client in that case was OSHA let the clock run out and didn't do a very detailed inspection. While a spotter does not generate revenue, having one could have saved both this pedestrian and the employee I reference above. It could also save a lot of liability expenses for the company who is operating that equipment, far more than the equipment and operate generate in any given year. #odworkplacesafety #osha #construction #backhoe #nyc #spotter
