They need to be fully insured and up to date with health and safety regulations. You also want to know how they handle the nitty-gritty stuff like timelines, budgets, and unexpected issues. Clear communication, a solid contract, and a willingness to tackle any concerns along the way are non-negotiables. An interesting decision in Roberts Construction Group Pty Ltd v Drummond Carpentry Services Pty Ltd [2024] VSC 246. The court was required to consider whether the question of the provision of particular services under a relevant “construction contract” was a jurisdictional fact. The court held that, provided a “construction contract” has been identified, the question of whether particular services were or were not rendered under that contract – as opposed to some other construction contract – is not a jurisdictional fact. For my part, it is difficult to reconcile this decision with the fact that service of a payment claim on a “person who is or may be liable to make the payment”, within the meaning of s 14(1) of the SOP Act (VIC), must be a jurisdictional fact. It is difficult to see how one can determine whether a payment claim has been validly served on "a person who is or may be liable to make the payment" - so as to enliven jurisdiction - without considering whether the particular services the subject of the claim were provided under the relevant "construction contract", as opposed to some other construction contract between the same or different contracting parties. https://lnkd.in/dHCMgYj3
