Mediation is an alternative dispute resolution method where parties are free to negotiate the terms of a settlement in confidence and without prejudice to any legal proceedings. The parties have freedom to be creative with the terms of the settlement that the court may not otherwise have the jurisdiction to award at a final hearing. Whilst there are numerous benefits to mediation, it is nevertheless a stressful, daunting and tiresome process that clients often want to avoid. Parties are often tempted to rehash arguments that have been exchanged in pre-action conduct, but mediation is a place to find common ground and structure a plan to move forward from the dispute, rather than proving who's right and who's wrong. There is rarely a win/lose outcome in mediation and parties often to walk away feeling like they've over-compromised or given away more than they wanted, but this is usually a sign of a good settlement. It is important for solicitors to manage the client's expectations before and during mediation, and to ensure they are well informed so they understand when to accept an offer. You don’t need a lot to get started—just the drive to take action. In 2019, I shared a two-page newspaper article from the Glasgow Times about how I started my business with just a phone, a laptop, and a £15 whiteboard. That was it. No office, no big investments, just a determination to make something happen. For young people looking at the opportunities around them, wondering how to get started—let me tell you, you don’t need much. Whether it’s launching your own business, getting noticed by a recruiter, or convincing a CEO to give you a chance, it all starts with action. The possibilities in the roofing industry, as we've highlighted through the #PeopleMakeRoofing campaign, are endless. But the question remains: How do you get started? You start by picking up the phone, recording a video, attending an event, or simply making a list of the businesses you’d love to work with. Grab a whiteboard, write down their names, figure out how to reach them, and decide what you’re going to say. Then, take that first step. The truth is, success doesn’t require perfection or a perfect plan. It requires action. The first step may not be easy, but it’s the most important one.
