Please see this information regarding a new (hopefully) fast track program for NJ owners/developers/contractors to receive their construction permit for qualifying projects in an expedited fashion. For those of you familiar with the New Jersey Licensed Site Remediation Professional program, (or LSRP) you may recognize several aspects of this new program for architects and engineers to self-certifying construction drawings for pulling permits. However, the program is not without risks to owners (especially were the qualified architect to withdraw from the project). Very happy to be sharing a piece of work that has been a long time in the making. The topic of building greener has alternately been at the forefront of the construction industry's aims (rightly) and a slightly overwhelming target steadily creeping towards the bottom of everyone's 'to-do' list (understandably). As a construction disputes lawyer, I see an industry that is working hard to overcome the barriers to becoming more sustainable but also one that remains reactive, rather than proactive, by nature. From where I stand, one major barrier lies in the legal liability issues associated with the reuse of construction materials: Why would a contractor accept the risk of utilising reused materials in the face of generalised and uncertain standards of care via which it could be pursued for an unpredictable breach? Why would an employer voluntarily (and in the absence of any industry guidance on form) fund the preparation of highly specific criteria for reuse to be incorporated into its contracts? Add that to our legal system's piecemeal approach to sustainability which can actually operate as a disincentive to reuse, and the challenge starts to seem too great. All are points I have tried to grapple with and now suggest a way through. This paper began life as the topic of my dissertation for the King's College London MSc in Construction Law and Dispute Resolution. I was subsequently honoured to receive a commendation from the Society of Construction Law's Hudson Prize Committee which has now published the abridged version in the SCL Journal.
