A unique case wherein the NCLT in the matter of Hotline Glass Ltd. Majdoor Sangh v. Jigar Pradipchandra Shah (CP(IB)/99/2019 directed the RP to consider claims of the Applicant as it is not time-barred and take steps to have provision regarding the same under the plan as per provisions of the IBC. Attached is the summary of the order. *My Views:* 1) The claimant should not have been allowed to file a claim at the first instance. 2) IBC very well prohibits filing a belated/time-barred claim. Reference may be made to DC order dated May 26, 2023 wherein the DC founded that the conduct of RP in admitting a belated/time-barred claim as unjustified and unacceptable. Further, the same goes against the ratio of the NCLAT order in Ome Prakash Verma (Suspended Director of Neesa Leisure Ltd.) Vs. Amit Jain, (RP of Neesa Leisure Ltd.). Hence, since filing of application for time barred claim is prohibited under the Code, filing of time-barred claims during the CIR process with the Resolution Professional is also barred. #ibc #ibc2024 #insolvency
