Privacy right now could be best described as a plate of broccoli and carrots: dreary, unappealing gobbledygook that lawyers and compliance wonks serve up. Maybe you scarf it down because you know you should, but nobody enjoys it. It doesn’t have to be this way. Companies that make privacy more appetizing can uplift their brands, transform their engagement with consumers, and responsibly mobilize data to compete effectively in an AI-first economy. (Don’t feel obliged to take my word for it – I’ll link the research in the comments.) Every super{set} company seeks to streamline or simplify a problem we've faced as serial entrepreneurs, and Ketch is no different. 🛡️ New State Privacy Laws in the US 🛡️ Several new state consumer privacy laws are set to take effect in 2024, including those in Florida, Oregon, Montana, and Texas. These laws introduce stringent requirements for data controllers and processors, emphasizing the protection of personal information and granting consumers greater control over their data. Key provisions include: 🇺🇸 Oregon Consumer Privacy Act: Effective July 1, 2024, it requires businesses to obtain explicit consent before processing sensitive data and grants consumers rights to access, correct, delete, and port their personal data. 🇺🇸 Texas Data Privacy and Security Act: Effective July 1, 2024, it mandates opt-in consent for the sale of sensitive personal information and applies to a broad range of businesses operating in Texas. 🇺🇸 Montana Consumer Data Privacy Act: Effective October 1, 2024, it includes robust consumer rights and imposes new obligations on data controllers regarding the processing of personal information. Many people, including those who have done #AIGP certification, have been advocating for the usage of differential #privacy as an important component in privacy-preserving #data analysis, especially when used intentionally in a broader context where other technologies are available. And then, I have met #datascience experts who aren't purists and do not agree that this is a solid technique to preserve privacy, mainly because it is a trade-off between privacy and utility. Differential privacy adds noise to data to protect the privacy of individuals. Still, this noise can also reduce the utility of the data, making it less accurate or useful for certain types of analysis. Recently, an X user posted how #anthropic injects texts into prompts to avoid #copyright infringement - whether it does or not, remains debatable. It also remains unclear if use of Differential Privacy could be a solid #legal defense in #dataprivacy related cases. But for now, it is an interesting piece of tech that #privacylawyers and #AI #law experts must know about. https://lnkd.in/ddQr4Rm3
