Construction Leadership Council is issuing clarification on Designers and Principal Designers presenting evidence of competence to assist with the demonstration of designer and principal designer competence and to allow for construction site access. Part 2A of the Building Regulations (Amendment) (England) Regulations 2023 introduces requirements for any person who is proposing to appoint another person to carry out building or design work to take all reasonable steps to satisfy themselves that the person being appointed fulfils the general competence requirements of Regulations 11F (1) and (2) and duty to plan manage and monitor work in Regulation 11J.

Good Folks! ─ unless I'm missing something here, the intention of BSA is to ensure only competent pros do construction and that those pro actors [statutory and non-statutory] who do the things and perform the actions are responsible for the designs and decisions and can prove they are all appropriately competent to deliver safety [YES?] ─ didn't Dame Judith Hackitt say to the industry pros "you know what to do, just do it!" and "don't wait for guidance!" ... ... so, now this latest survey highlights ─ confusion about the Building Safety Act 🙄 and asked: 1️⃣ Do you feel like you’ve got a full understanding of the requirements of the Building Safety Act? 2️⃣ What about your supply chain? 👉 The most compelling responses highlight very real worries at the coalface. “Another piece of legislation that has not been practically thought out or trialed,” said one respondent ~ 🔳 [Schedule 1 BSA is a list of amendments to the 1974 HASAWA to facilitate the new BSR and new dutyholders ─ so, BSA isn't really 'new' but more 'existing done better' -YES?] 👉 “It’s still grey in too many areas and there is too much other legislation and PAS requirements that confuse the situation,” said another ~ 🔳 [remember, the PAS are only 'guidance' NOT 'requirements'‼ - competent pros should understand that fact!] 👉 The lack of clarity was echoed by other respondents. “Too little training, very vague information, implementation should have been a step change as opposed to a huge undertaking at once,” said one ~ 🔳 [true enough, and with many charlatans peddling snakeoil for the unaware! - truly competent pros know bits of logo plastic don't confirm competence - Yes/No?] 👉 “There is no clear framework of guidance from the regulator – everyone is making it up as they go along with their own interpretation of what is required,” bemoaned another ~ 🔳 [the BSR is NOT going to issue 'guidance' and is there to Regulate, Enforce and Monitor the law - it is for the pro actors to Comply appropriately Competently with the law - YES?] 👉 One respondent dived into aspects of the golden thread: “[There are] unclear definition and requirements about data and BIM – where to host it for compatibility, no client buy-in to supply a common data environment for an ultimate golden thread of non-siloed workflow.” ~ 🔳 [it's for industry to work out how to work digitally - hmm, I know there's an elephant in the room 🐘 with >58% digital illiteracy across industry in at least 2 of 20 Essential Digital Skills FutureDotNow research findings!] 🔵 The Institute Of Construction Management is collaboratively working on robust solutions for the future: 🔹 Our industry MUST competently lead itself! https://lnkd.in/es8igjCW 🔹 Forward vision 2024++ https://lnkd.in/eWbUzWFz 🔹 Latest #ICM News - scroll down to where it all began https://lnkd.in/eEAAEZWe

🔍 **Understanding the Crucial Role of the Principal Designer under the Building Safety Act (BSA)** 🔍 The Building Safety Act (BSA) has brought significant changes to the construction industry, not least the introduction of the Principal Designer role. This position is not just a title—it's a pivotal part of ensuring safety and compliance. At its core, the Principal Designer's responsibilities revolve around: - 📑 **Meticulous Record Keeping:** Ensuring all documentation is up-to-date & comprehensive. - 🛠️ **Monitoring Best Practices:** Keeping the design process aligned with the highest standards of safety, regulations and standards. - 🧩 **Ensuring Competence:** Verifying that every member of the design team is knowledgeable and produces work which is compliant with the Building Regulations. However, it’s easy to fall into the trap of complacency. Never assume that every designer in the team, your professional indemnity (PI) insurer, or your clients are as well-informed as you. Here’s why we must stay vigilant: 1. **Continuous Education:** Regularly update your knowledge and that of your team on the latest regulatory changes. 2. **Clear Communication:** Maintain open lines of communication with all stakeholders to ensure everyone is on the same page. 3. **Proactive Oversight:** Actively oversee the design process to catch potential issues early and ensure compliance is maintained. To support all of us, both **CIAT** (Chartered Institute of Architectural Technologists) and **RIBA** (Royal Institute of British Architects) offer specialised Principal Designer courses and registration. ❓ **Question:** Has anyone taken the CIAT Principal Designer Non-HRBs or HRBs course, or the RIBA Principal Designer course? Which would you recommend and why?
