I wrote a piece, published by Lawyer Monthly, about the development of ESG-related litigation. In my article, I say that more courts worldwide are issuing judgements in favour of protecting the climate. I outline the significance of a number of legal rulings and explains why the future of ESG litigation is “an intriguing proposition’’. An increase in climate-related litigation against non-financial institutions and a more diverse range of corporate actors can be expected. I detail possible grounds for such action and the difficulties that can be faced by those attempting to bring such cases.
