A fundamental reform of the “Common European Asylum System” was adopted by the European Parliament in April. #CEAS The core elements of the reform are asylum procedures to be carried out as quickly and “efficiently” as possible directly at the external borders of the EU, so that asylum seekers can be deported to their countries of origin and to so-called “safe third countries”. Especially if they come from countries with a low chance of being accepted. The EU-Turkey deal of 18 March 2016 can be seen as a prototype for this third country regulation. 🎙 In the latest podcast episode VIDC director Sybille Straubinger talks with Neva Övünç Öztürk, a Turkish lawyer & assistant professor at the Faculty of Law at Ankara University, about the effects of the EU-Turkey deal and the outsourcing of European asylum policy: https://lnkd.in/dWU_3dHf

From Fear to Hate: Legal-Linguistic Perspectives on Migration (Volume 6 in the series Foundations in Language and Law) Despite the diverse linguistic data, approaches, and methodologies employed, each paper offers a comprehensive understanding of hate speech – defined as “speech acts that can potentially express hatred and generate hate in larger sections of the population” (p. 11). This exploration is contextualized within the broader global phenomenon of migration, examining it through three overarching perspectives: language, discourse, and law (p. 18). Pleased to share a new article, with my colleague Violeta Kapageorgiadou, PhD: Graca, S and Kapageorgiadou, V (2024) “(…) Here I Have Freedom”—A Study of Refugees' and Asylum Seekers' Legal Consciousness in Greece: Self-Identity, Human Rights, and Expectations from European Union Law.” Law & Policy 1–26. https://lnkd.in/eeB3gejM #migration #legalconsciousness #refugees #asylumseekers Bit of a mouthful of a title, but hopefully useful for scholars and practitioners. ⚖️ The international legal framework in which the #MemorandumOfUnderstanding between #Italy and #Libya is embedded is quite clear: Libya is violating the human rights of #migrants and asylum seekers on its territory. 📖 Italy's complicity becomes equally clear when analyzing the facts in light of the most relevant international instruments on the matter. 📑 Let us review them briefly. 📌 Building on our Article 15 Communication to the International Criminal Court, UpRights and StraLi for strategic litigation recently published the #report "Navigating Troubled Waters: Italy's Human Rights Dilemma in the Mediterranean," which reiterates the urgent need for Italy to reformulate its approach to international cooperation in the area of migration. 📕 Read the report and the communication here: https://lnkd.in/ddKv94Ek

🌍 The international scientific conference "Migration Challenges - Legal Responses in General Terms" was a great success. 🔍 The main issues to be addressed at the conference included the clarification of terminology: the concepts of "refugee" and "migrant". The interpretative framework is the interpretation of the UN Refugee Convention, with particular reference to illegal entry and the principle of non-refoulement. 🎥 Videos of the conference are now available on our YouTube channel by clicking on the link. 🖱️ https://lnkd.in/d7qcGuNC... #cea #centraleuropeanacademy #professorsnetwork #conference #researchers #professors #migration

6d"the decision to examine an asylum application through a sub-standard procedure, severely limiting the applicant’s rights, would largely be based on the results produced by an AI language recognition software that is grounded on wrong assumptions regarding the relationship between language and nationality and has proved to be inaccurate" beware of fundamental rights impact assessment (FRIA), including mitigating measures, when it is about the use of an AI that already puts the defendant (the AI subject) in a difficult position ..
