I was asked how employers can minimize the risk of employment litigation. I responded with the following: A: "Companies need to possess a thorough comprehension of the obligations that employers have, particularly in California, and to train their supervisors and managers accordingly. Employers need to ensure clear policies and procedures are in place so that employees know what is expected of them. Many cases I see arise because the employee did not understand that they were not meeting basic performance standards, and thus they feel blindsided at facing discipline or termination. Sometimes employers will think that they have communicated clearly when they have not. The United States Supreme Court last week issued a decision that could increase employers' exposure to Title VII #lawsuits over job transfers, as the justices found that #plaintiffs in such cases are not required to show that they suffered significant harm from a transfer. Instead, as #NewYork Partner Peter Shapiro explains in a new #ClientAlert, the high court held that a plaintiff instead must plead and prove only that the transfer brought about a disadvantageous change in a term or condition of their #employment.
