https://buff.ly/3VH04Hv This decision by the Alberta Court is clearly setting a precedence when it comes to What is a Motor Vehicle Accident? If you are out of your motor vehicle as it has broken down or is not in a state of being operational and seeking help, you are still deemed to be operating a vehicle and hence if your actions cause bodily injury, property harm or any other harm, you have caused a Motor Vehicle Accident? Setting aside the legal principles for one minute, one has to ask ourselves "Does this make sense?" and "Should one be held liable for one's actions when one is clearly not behind the wheels?" The answer looks more a No rather than a Yes. Irrespective, we now have ruling which is legally binding and drivers are warned that their actions even though they are not technically operating a vehicle can still be perceived as causing a motor vehicle accident. In the current case, the concept of proximate cause takes precedence over Time and Distance with regard to operating a vehicle. The actions of the driver led via an unbroken chain of events to the Accident causing trauma to the third party. The supposed victim who was hit by the third party was actually deemed guilty of causing an accident. As a driver, we commonly encounter situations where pedestrians do not exercise due care when crossing the street. Would the pedestrian if hit then still deemed guilty of causing an accident and liable for damages to the driver? That could indeed be a possibility.
An uninsured driver who was struck and killed 40 metres away from her vehicle while trying to flag down help from the shoulder of a remote highway was in fact involved in a motor vehicle accident, Canada’s top court has confirmed.
