AMENDING A PLANNING PERMISSION: HOW FAR CAN SECTION 73 GO? Odette Chalaby discusses the scope of section 73 TCPA and whether it can be used to amend conditions if the result would be a permission fundamentally different to the original grant. Read more: https://lnkd.in/e7xn6R5v

Essential reading for anyone who has ever assumed that a Section 73 application is just a formality. My advice is to keep the development description on a planning application form as succinct and vague as possible, making it easier to amend the suite of plans if needed in the future. Some local planning authorities insist on amending your wording to something longer and more prescriptive, which I believe is not in anyone's long-term interest. Don't be afraid to contest an amended wording when you receive a validation letter. Your average validation officer is not usually up-to-date with the case law.

Another key element to s.73 TCPA1990 permissions is the impact on #CIL or #CommunityInfrastructureLevy with exemptions or relief already granted on the earlier permission are continued (or extended) to the new s.73 permission relating the CIL saving in accordance with Schedule 1 further to SI 2019:1103. Important that always prospective works as seen numerous #LocalPlanningAuthorities #LPAs seek to grant s.73A against an application made under s.73 if consider that any element retrospective... stripping away any previously granted self build exemption. We can't overstate the importance of evaluation criteria for any proposal-preparation process. Yet, many new PIs are not familiar with them. The entire proposal evaluation process *must* be built around the published evaluation criteria. Be sure to check them often if you are not in the habit of doing so yet.
