PORT ST. LUCIE — A state-of-the-art pickleball facility in Port St. Lucie has abruptly ceased operations, notifying customers of its closure with only 24 hours' notice. Members who paid significant fees, including annual dues of up to $500, are now questioning if they will be reimbursed. The Pickleball Club cited financial challenges in an email to patrons, stating they lacked the resources to continue operations. In addition to the Port St. Lucie site, a facility in Lakewood Ranch, near Sarasota, is also being liquidated. Customers like Chris Erickson, a three-month member, expressed frustration over the sudden closure, feeling shortchanged on their investment. The club’s email did not specify whether refunds would be issued, leaving many in limbo. CEO Brian McCarthy has not yet commented on the future of the company's remaining projects, which include nine buildings under contract across Florida. #portstlucie #stluciecounty #treasurecoast

I like donuts. Fortunately, there’s an old-school traditional donut shop in my town where I can get my fix. They make the donuts (and other goodies) daily and it’s exactly what you’d want. They have crullers. Twisted, glazed deliciousness made by hand the way crullers are supposed to be made. And Bavarian cream, done the right way. No matter which one(s) you choose, you know what you get is going to be exactly like you want that particular donut to be. Being a transactional lawyer is not at all like this. Due diligence surprises, uncooperative shareholders or third-parties and incomplete information can be challenging for a variety of reasons. There’s nothing more fun than reviewing a cap table and finding out that the spreadsheet doesn’t contain any formulas, only hard coded numbers. Or finding out that your commercial leases don’t require an SNDA and the tenant won’t budge on this issue. Deals inherently involve risk, but adherence to best practices by operators, acquirers and investors can make it much easier for your team and your lawyers to sort through the information dump and know what you’re going to get. To finish off my #earlymorning #soapbox moment regarding the #AutumnStatement let's take a slightly note. Whilst #alcohol #duty is increased, duty on #draught alcohol (2/3 of pub sales) is dropping by 1p in the pint. Where’s the planning link I hear you shout? Well - one of the more contentious local issues we planners deal with is change of use applications at much valued #local #pubs – which in most cases are only closing as they can’t afford to stay open. I’ve advised more than one planning committee reluctantly approving housing on a pub site, warning “use it or lose it” to the protesting locals. Good local pubs are community hubs and when they're gone they're a real loss, but they are also businesses and need to make a profit to stay open. Is there an incentive being created here, for those of us who like the occasional tipple, to enjoy it in a pub, with friends, not at home. Jeremy Clarkson has recently opened a pub and I hope that #ClarksonsFarm Series 4 puts the same focus on the difficulties borne by the #pubtrade as Series 1-3 has put on #farming. Maybe he'll be weighing in on this topic soon - is a couple of pence off the average pint (whilst all other operating costs keep going up) enough to save the #localpub? #budget #budget2024 #planning #pub #draughtbeer

We love catching up in person with clients and colleagues to chew the fat. It's how good business is done. Emails and phone calls don't create relationships or connections. To do that however, we need to support our local hospitality outlets. We all get that you are really struggling right now, but when you charge me $21 for a small glass of wine and then hit me with a $2.45 surcharge fee for using my credit card, I may not return in a hurry. Where does the surcharging end? Will you charge me for using your carpark? Surcharge me for your cleaning staff? Am I being unreasonable? #surcharges #hospitality #business #relationships
