Order V of CPC - Issue and Service of Summons Once the Suit is instituted, summons are issued to Defendants to appear and defend the case. Summons are required to have the copy of plaint annexed with it. The mode of service is post and/or registered post (Rule 9 and 10) Moreover, there is Rule 20 which deals with ‘substituted service’; which lays down methods such as pasting of summons at residence, electronic device, publication etc. It is upon successful service of summons, service is held good and the case is proceeded to the next stage.
