As we continue to shine a light on the urgent need for probation reform, Yovng Chimi sat down with us firsthand to share his gripping story, which underscores the critical work we’re doing to transform the probation system. Yovngchimi’s journey through the probation system is a stark reminder of its flaws: • He spent three years on probation for a marijuana offense, facing a system that seemed designed to trap rather than rehabilitate. • Instead of getting meaningful support, he found himself accumulating violations due to lack of proper resources. • His career as a musician took a severe hit when attending an award show led to increased restrictions, including an ankle monitor that made him feel like he was “in prison.” • A strict 6 PM curfew further crippled his ability to pursue his music career and maintain a normal life. • Realizing his restrictions was the reality that, at any moment, he might have had to choose between risking a violation or seeking emergency medical care for his child. Yovngchimi’s story is not unique. It represents countless individuals caught in a probation system that often hinders rather than helps. His testimony reinforces our mission to create meaningful change, ensuring that probation is a pathway to stability and success, not a revolving door back into the justice system. We are deeply grateful to Yovngchimi for sharing his experiences. His story fuels our determination to push for reforms that will make a real difference in people’s lives. When someone says that people on probation need accountability, what they typically mean is that probation should be punitive. Everyone wants justice reform, but many cannot embrace the idea of teaching probationers methods of creating inner change. One of the reasons justice reform is difficult is because so many equate “accountability” with making sure that probation isn’t easy. Many people in the system want probation to “sting a little”. But what does the research show? Is Brainhealth achieved through stress, financial hardship, and disrespect? People on probation have already experienced an arrest, jail, bond conditions, fees, lawyers, prosecutors, trials or pleas. Their case may have been pending for years before they received a conviction that will be on their record for the rest of their lives, creating limitions and hardships that may never go away. When they are placed on probation, this is an opportunity to cultivate skills that create a new future and a different way of thinking. To do this, we need to reduce stress and anxiety and promote wellness and brainhealth. We are doing this in New Direction. And, the only obstacle that we face are those who do not want probation to change, and those who feel it doesn’t “sting” enough. But, that’s the way it always is in the beginning.

Understanding the Probation of Offenders Ordinance 1960 in Pakistan. Today, I want to shed light on an important topic related to our legal system. Many people might not be aware that there is a beneficial option available within our criminal law framework. If you are charged with an offense and there is a possibility of a conviction, our legal system offers an alternative where you do not have to serve time behind bars. Instead, you may be placed under probation, which means you will be assigned to a reformatory institution rather than a prison. Here, you will receive training and regular assessments to help you reform your behavior. This provision, established under the Probation of Offenders Ordinance 1960 and the West Pakistan Probation of Offenders Rules 1961, allows for probation in cases other than those involving capital punishment or life imprisonment. Specifically, Section 5 of the Ordinance outlines that probation can be granted for offenses not punishable by death or life imprisonment. There are certain prerequisites for probation, and it is available for both men and women, with some exemptions for women offenders. If you find yourself in an unfortunate situation, probation offers a chance to avoid jail time and instead focus on personal reform. You will need to report to a probation officer regularly and work on improving your behavior. The probation period can range from one to three years, during which you can continue your daily life activities while adhering to the probation requirements. An interesting aspect of this ordinance is that successful completion of probation is not considered a conviction. This has been upheld by recent legal judgments, emphasizing that probation is a rehabilitative measure rather than a punitive one. It is crucial to highlight and utilize such positive aspects of our legal system. Often, individuals get entangled in minor legal issues and face trials. In such cases, opting for probation can be a beneficial alternative to facing a full trial and potential conviction. I hope this information is useful and informative.
