I’m reaching out to this network to raise awareness about the Migration Amendment (Removal and Other Measures) Bill 2024. The proposed Bill is of grave concern because it: · empowers the Minister for to issue a broad range of directions requiring non-citizens to facilitate their own removal from Australia if they are unlawful or hold a bridging visa subclass 050 of 070 (ss 199B and 199C) · criminalises non-compliance with those directions (s199E) · grants the Minister a broad power to make regulations designating any country as a “removal concern country”, which is not subject to the rules of natural justice (s199F) · deems any visa application by a non-citizen from a removal concern country invalid, subject to limited exceptions (s199G) If passed, there is a risk the Bill may pose a significant obstacle to the reunification of families with members in "removal concern" countries, and undermine the rights of non-citizens seeking safety and opportunity in Australia. Challenging Hoppe – owning the cabin does not make you owner of the mountain A polemic between libertarians in general and anarchocapitalists is the issue of freedom of migration and state-imposed border restrictions. Certain writers such as Hoppe propose that with the disappearance of the state everything would become private property and therefore there would be no complete freedom of migration. He proposes that since you paid taxes to the state for roads and sewers and other public works, therefore a migrant has no right to avail himself of that benefit that you paid for. Suppose you have built a cabin on a mountain. You have cleared some of the forest and undergrowth and then, with your own labor, you have built the cabin. Does that now make you the rightful owner of the entire mountain? It can be argued that your property consists of the fruits of your labor: the clearing of the forest and the cabin you have built. But you have not built the mountain or the forest. These belong to the realm of nature, which follows its own laws, not the laws of man. The same argument applies to government claims on land. In the US, the state of New Jersey is the most densely populated. However, even in the north of the state you can find many undeveloped hills, forests, and trails. There are many rivers. Who owns these? Are they owned by the original indigenous inhabitants, such as the Lenape or Ramapo tribes? If these tribes did not build anything there, what right do they have to the mountains, rivers, and valleys? Why should a landowner who lives near a river or mountain have the right to determine who can walk those trails or navigate those rivers? By what right? Does your ownership make you the owner of someone else's body? How is it not kidnapping when you restrict someone else's freedom of movement? The way to deconstruct Hoppe’s argument is to expose the fallacy that the government owns nature or that landowners own nature. They don’t. Nature is its own realm. If the state were to disappear tomorrow, the only legitimate walls would be at the entrance to private property, not at imaginary lines on a map called borders. An innocently traveling migrant is not the aggressor.
