It is a known fact that the Digital Operational Resilience Act(DORA) takes precedence over NIS 2 Directive. The reason for this is in Article 4(1) of NIS 2 Directive which states that where a sector-specific EU law has at least the same requirements as NIS 2 Directive, the former will take precedence. This is known as "lex specialis" doctrine which states "that if two laws govern the same factual situation, a law governing a specific subject matter (lex specialis) overrides a law governing only general matters (lex generalis)"-Wikipedia. DORA applies specifically to financial entities in the EU and so takes precedence over NIS 2 Directive which is a general law applicable to essential and important entities (spread across multiple sectors ) in the EU. #europeanunion #DORA #NIS2Directive #ENISA Forum of European Supervisory Authorities (FESA)

The 2020 amendment to the Act on the Protection of Personal Information (“APPI”) stipulates that the APPI must be reviewed every three years — the time for a review has arrived. In the past, since its enactment in 2003, major substantive amendments have taken place in 2015, 2020, and 2021. For the current review, an interim report compiled by the Personal Information Protection Commission (“PPC”) was released on 27 June 2024. The PDP Amendment Bill was passed at Dewan Negara (Senate) yesterday, 31 July without any amendments. The Bill will officially become law once given Royal Assent and will come into effect on a date to be specified by the Minister. The development of the Guidelines and subsidiary legislation would be crucial in guiding data controllers on the additional obligations that have to be complied with and ensuring robust implementation of the new law. It is anticipated that these will be issued for stakeholder consultation in the coming months. #dataprotection #pdpa
