In San Francisco, we turn to attorneys like Dan Bornstein to help owners and agents navigate the multitude of rent control and tenant provisions encountered in both leasing and selling properties with units. Here is a brief test for those not familiar. The answers to all questions are “Yes”. 1) Can an owner be fined for leaving a unit vacant for too long? 2) Does an owner need to tell the City each year who resides in each unit and what they pay? 3) If an owner wants to move into an occupied unit is there a fee to be paid to the tenant? 4) If you want to sell your 3+ unit building, do you 1st have to offer the building to a group of non-profits approved by the City? 5) Once under contract, do you have to again re-offer the property to the non-profits for their possible purchase at the accepted purchase price? 6) If a non-profit decides to purchase, is the first Buyer bumped out of contract? 7) Once a property is sold to a non-profit, does it remain a non-profit property forever? 8) If a buyout is agreed to between the owner and a tenant, does the City retain a copy of the agreement? 9) Average buyout for a tenant is about $50K. 10) Was the highest buyout paid to a tenant $470K? #SanFrancisco #apartments #cre #rents #buildings #rentcontrol #realtor #buyout #commercial #realestate #multifamily

Section 8 Notice - is your ground mandatory or discretionary?
