There is a better way! “Amy Fischer, the Director of Refugee and Migrant Rights at Amnesty International USA, said in a statement that Biden’s actions “set a dangerous international precedent.” “It’s deeply disappointing to see President Biden so hellbent on dismantling human rights for people seeking asylum and implementing policies that are plainly illegal under international and refugee law,” Fischer said. President Biden’s actions on Tuesday come as the numbers of unauthorized crossings in the U.S.-Mexico border have continued to go down in recent months, defying migration patterns. In April, U.S. Customs and Border Protection reported nearly 129,000 encounters (vs. 250K in DEC). Maribel Hernandez Perez, director of policy and government affairs for border and immigration at the ACLU, said Biden’s latest executive order will likely have a negative impact on the legal pathways of migration to the U.S. “Whenever you do anything that bars people from applying for asylum, what you're doing is in fact disrupting the legal pathways that people have,” Hernandez Perez said. Border... one word – different meanings For governments, borders must be protected from irregular migrants through different means like fences, walls, surveillance technology, and border patrols. For asylum seekers, borders symbolize the divide between danger and safety – determining their legal status, rights, and chances of integration into new societies. For public opinion, borders and their management shape their perception of migration trends and policies. The implementation of dynamic, effective, and human rights-compliant border procedures poses a considerable challenge that needs to be addressed. The Council of Europe's Committee for the Prevention of Torture recently released the below report on its ad hoc visit to Greece at the end of 2023, highlighting the need for authorities to reform the immigration detention system and stop pushback. Last September during a visit to Athens I observed the efforts undertaken by the authorities to improve the situation, especially of the unaccompanied minors. The White House is finalizing plans for a “U.S.-Mexico border clampdown” that would shut off asylum requests and automatically deny entrance to migrants once a certain number of border crossings have been met. An expulsion power like this will bar people fleeing grave harm from even asking for asylum in the U.S., force them to wait in dangerous conditions, and exacerbate many of the current challenges we’re facing at the border. People arriving at the border have the right to begin the asylum process—regardless of where they are from, how they arrived, or how many people have arrived before them. However, our government continuously is making this process more difficult with unfair policies like this that only put people’s lives at risk. We call on the Biden Administration to reconsider and instead find a real solution and efficient way of processing people who are in search of safety. The Biden/Harris administration reversals of the Trump Administration's significant border-related executive orders continue to directly lead to changes in migrant crossing patterns at the U.S. southern border. Key actions taken by the administration, which have contributed to ongoing illegal migrant border violations include: 1. Suspension of the "Remain in Mexico" Policy (Migrant Protection Protocols - MPP) 2. Suspending Deportations: 3. Termination of Border Wall Construction and Border Wall Maintenance: 4. Reversal of Asylum Restrictions and Cooperative Agreements 5. Executive Order on Root Causes of Migration: FACT: The cumulative impact of these policy reversals has been a significant increase in migrant crossings at the U.S. southern border. The Biden/Harris administration's changes created new incentives for migrants, particularly asylum seekers, as they anticipated better treatment and greater opportunities for entry under the new administration.
