On Tuesday, Bordeaux-based Chateau Bauduc, and UK importer, Decorum Wines appeared on Radio 4’s PM to discuss with Evan Davis what faces the wine industry, and UK supply chain if the temporary easement ends on 1st February 2025. The effects are clear: More complexity and higher costs for business, reduced choice, and a less attractive and more burdensome route to exporting to the world’s second largest wine import market. Alcohol harm costs New Zealand $9.1billion. Price controls are one tool we have to mitigate against that harm. Great to see NZ Police taking this action on alleged serious breaches of the law to protect NZers from harm. "There were multiple occasions of New World’s website promoting alcohol at discounts exceeding what is legally allowed, with Paulin finding 44 breaches on December 6, 2023 alone. A Waiata Sauvignon Blanc was the most extreme example found, showing a discount of 53% for club card members." https://lnkd.in/e4EuX7iv

A recent decision by the NSW Court of Appeal upheld the principle that the plaintiff bears the onus of establishing the cause of his accident. In circumstances where the plaintiff is unable to establish this cause on the basis of the evidence available, the defendant cannot be presumed liable for the incident simply by the mere fact that it occurred. This decision reiterates the importance of a plaintiff being able to clearly identify the facts and circumstances which caused the subject accident to occur. Thatchers Cider wins landmark trade mark case against Aldi 🍋 The Court of Appeal ruled in favour of Thatchers, overturning a previous High Court decision from January 2024, which had dismissed claims. Lord Justice Arnold found Aldi's Taurus Cloudy Lemon Cider infringed upon Thatchers trade mark, with intentions to remind consumers of Thatchers product, conveying it's similar but cheaper. The Court held that the use of the names “Balsamico di” and “Ristretto di Balsamico” were in breach of Regulation (EU) 1169/2011, as the indication on the bottles was neither fully clear nor easy to understand by consumers. As for the use of the denomination “vinegar”, the Court held that it could not be lawfully used as the dressings were not produced according to the definition in Art. 49 of Law No. 238/2016 and therefore it was an undue use of a legal denomination, also prohibited by Regulation (EU) 1169/2011" 👇 more below
