One of the most common questions I get is, 'I wasn’t read my Miranda rights – does that mean my case will be thrown out?' The answer isn’t always straightforward. The fact is, Miranda warnings don’t have anything to do with the legality of your arrest itself. Police don’t always have to read you your rights unless they’re interrogating you while you're in custody and you start providing incriminating information. If you didn't confess to anything, even if they didn’t read your Miranda rights, your case is unlikely to be dismissed based on that alone. However, if you were being interrogated, provided information, and weren’t warned about your right to remain silent or your right to an attorney, then there’s a chance we can suppress those statements.
