There are a myriad of issues with this rule including (but not limited to): lack of electric infrastructure, lack of viable electric truck options for most use cases (including long-haul), and astronomical cost. Saying the state of commerce in the state will be harmed dramatically unless action is taken, a group of 33 business organizations are urging the Legislature to pass a bill that delays the state’s participation in California’s electric truck regulation (called the ACT) until at least July 1, 2027. In a letter to State Sen. President Nick Scutari (D-Clark) and Assembly Speaker Craig Coughlin (D-Woodbridge), the groups urged the passage of bills sponsored by Sen. Diegnan (S3817) and Assemblyman Calabrese (A4967), which calls for the delay. The ACT regulation, which is scheduled to take effect on Jan. 1, 2025, requires a certain ratio of EV trucks to be sold relative to regular diesel trucks, before additional diesel trucks can be sold. While the point of compliance is upon truck manufacturers, they are enforcing it against truck dealers. As of fall 2024, New Jersey truck dealers report that they are not able to satisfy customer requests for new heavy-duty diesel trucks since they haven’t sold the requisite number of heavy-duty EV trucks.

It is important to differentiate between “trucking companies” and “truck manufacturers” or #OEMs. “#Trucking (including #Drayage) companies”, move things, typically #Freight, “#Truck Manufacturers” on the other hand, build trucks that they seek to sell to “trucking companies” to be used in the movement of freight. It is important to differentiate because from the POLITICO article below, it is easy to take away an impression that the California Air Resources Board is making it “easier” for “trucking companies” to comply. Not the case. The #ACT modifications impact truck manufacturers, it currently has no bearing on the compliance burden for “trucking companies” contained in the currently unenforceable #ACF… And the other states who are “peeling back” are doing so on the #ACT and the “Low NOx Omnibus Rule”….which both are geared to “Truck Manufacturers”…. Say nothing of #TruckDealers who are caught in the middle. This stuff is nuanced no doubt, and perhaps merely a function of #semantics or journalistic license, nevertheless it is important to be clear so as not to confuse the public at large in how “trucking companies” are being impacted by State of California “regulators”. “But California regulators are also making it easier for trucking companies to comply. The board on Thursday voted to amend the Advanced Clean Trucks rule to give companies more leeway to comply with the zero-emission sales mandate by making it easier for manufacturers to receive sales credits and giving them a three-year makeup window if they fall short of their EV requirements in a given year.”
