The Health and Safety Executive's report highlights a concerning spike in construction industry deaths, rising from four to 51. Ruth Wilkinson from the Institution of Occupational Safety and Health emphasises the urgent need for action, particularly in high-risk industries. This case heard today in Mullingar District Court, further demonstrates how essential it is that employers manage and conduct work activities to ensure the safety, health and welfare of all its employees. While the employee did survive, he sustained serious injuries after falling over 7 meters to the concrete floor below. There is no clear cut definition of practicable and a person with minimal OHS & no construction management experience would have a very different view of practicable as compared to a safety professional that is very experienced in site safety - has experience in construction management plus has done work as a site supervisor with multiple trades, they have a far better understanding of construction site logistics as to what is Wip or what constitutes a hazard to workers - it is such a simple issue so just deal with it and it will meet compliance with WorkSafe BC’s gray area policy’s on such matters - and if you do not have enough experience you will develop anxiety and sleeplessness and not fully solve the issue because you will not be able to effectively present your case for judgement-and thus I rest my case 😎
Flush toilets are coming to a BC construction site near you October 1... or are they? The new OHS Regulation section 20.3.2 comes into force October 1, and requires flush toilets at construction sites with 25 or more workers. However, the section only applies where it is "practicable" to provide flush toilets. Huh? So are they required or not? Much ink has been spilt trying to figure out when something is practicable. The word is a favorite with the OHS Regulation drafters: it appears 214 times in the Regulation, more than any other statute in BC. Each and every use creates ambiguity, room for argument and confusion, and opportunities for inconsistent application by officers. For flush toilets, WorkSafeBC has issued a four page interpretive guideline to "assist" employers who are trying to figure out what the law even means. Employers will now need to run through a set of "non-exhaustive" factors and balancing of considerations to determine if they got it right. Employers will then be subject to scrutiny from WorkSafeBC as to how they determined what WorkSafeBC's law requires. I am all for improved working conditions, but I am not a fan of legislative ambiguity. If it's not "practicable" for the drafters of the law to say when it is going to apply, maybe that's a clue it's not a great law to pass! #construction #ohs #safety #administrativelaw https://lnkd.in/gKAQJSYM
