While the legislative environment remains largely solid, the needs of the modern workforce have dramatically changed. The construction industry, known for its physically demanding nature, is particularly vulnerable to the escalating risks posed by extreme heat. Recognising this, the US based Occupational Safety and Health Administration (OSHA) has taken a significant step towards mitigating heat-related illnesses and fatalities with a proposed new heat rule. This landmark initiative aims to establish clear guidelines and standards for employers to protect workers from the dangers of excessive heat. It mandates heat illness prevention plans, requires heat-related incident reporting and emphasises worker training and emergency response. Malta’s Prime Minister has stated that Parliament is working on a bill proposing new, tougher workplace health and safety measures. The proposed legislation follows in the wake of the public inquiry into the death of Jean Paul Sofia for which the Public Interest Litigation Network (PILN) worked together with Isabelle Bonnici, the mother of the construction victim. The inquiry, which the Government resisted and then initiated under public pressure, concluded last February that the Maltese State is responsible for Jean Paul’s death, generating discussion on the regulation of workplaces to ensure safe working conditions and the need for legislation to ensure this happens. The setting up of a public inquiry in Jean Paul Sofia’s case was essential to question whether the young worker’s death could have been prevented, whether there were any failures in the system that are contributing to fatalities and injuries on construction sites, and how reasonable action could be taken to prevent avoidable fatalities and injuries on construction sites. Any changes in legislation and regulation of workplaces should ensure that lives are properly protected. The PILN reiterate the importance of a transparent and public process of inquiry in cases of public interest as it is the only way for the State to learn how to prevent future deaths. However, if the lessons learned are to save the lives of others, the State must follow through with swift and holistic change. We therefore expect the Government’s proposed bill to effectively protect workers, especially in dangerous industries. #workplacesafety #construction #regulation
