In an unprecedented move, the EU has recently delisted Abr Arvan, an Iranian IT company previously sanctioned for its role in censorship and violating internet freedom. As Mahsa Alimardani, a senior fellow at the Open Technology Institute, pointed out in her informative and well-founded article, this decision has raised many questions. I believe that the EU's decision was fundamentally flawed, both in terms of factual accuracy and legal grounds. Please read my full position and the entire article for more details. https://lnkd.in/dkSJKWEz

📢 A new report contributed by Science Feedback and Alliance4Europe presents evidence that Russian state media remains accessible on Meta Platforms despite EU sanctions. 🔵 As of July 31st, 2024, at least 52 Facebook pages and accounts of Russian media entities and individuals sanctioned by the EU, or amplifying their content, are accessible to EU audiences. 🔵 These pages have around 3.9 million followers on Facebook. 🔵 Since March 2022, 10,000 posts have shared links to mirror websites of these sanctioned media across four European languages. 🔵 Council Regulation No 269/2014 prohibits hosting content from these channels or making them available to EU audiences on video-sharing platforms, as clarified in Commission guidance updated in mid-May 2024. 📑 Read the full investigation: https://lnkd.in/g2BYq6FK This report is the fourth in a series examining how major online platforms enforce EU sanctions on Russian media entities. Previous reports have covered YouTube, TikTok, and X (formerly Twitter). In this installment, we investigated major platforms such as Facebook, Threads, WhatsApp, and Instagram.

📈 In 2023, 16.7% of all applications for international protection in Belgium were subsequent applications (i.e. a further application made after a final decision has already been taken on a previous application). This is more than the year before, where the share of subsequent applications was only 12.6% of total applications. 🦌 The same phenomenon has been observed in other European countries. Recently, our Finnish colleagues launched an Ad Hoc Query to map the strategies for processing subsequent applications, the reception services offered to applicants, and the overall implementation of Directive 2013/32/EU on common procedures for granting and withdrawing international protection (recast). 👉 Read the full results of the query here: https://lnkd.in/eAwRyBwz

⁉ Sanctions update - what's going on in the EU ⁉ Several noteworthy developments have / are taking place in the EU, just to highlight a couple of these: ▶ No Russia-clause The European Commission end of last week launched a public consultation to gather input on the real world application, specifically asking whether companies have experienced difficulties to implement the clause, use of broader sanctions clauses and impact of the clause on companies (for example in the renegotiation process of contracts. Also worth highlighting is the impact it could have if the measure were to be extended to non-EU subsidiaries of EU companies. You can find the full consultation here - it's definitely worth reading and considering to provide feedback https://lnkd.in/exAGKxMn ▶ Ukraine loan cooperation mechanism Following green light from the European Parliament, Council and the US apparently dropping its demand for longer EU asset freezes, it's time to iron out the outstanding (key) detail of the loan. As announced by the G7, expect the term sheet with more details to be published in the next days. Also something to keep an eye out for: 1️⃣ Timing: the G7 mantra so far has been to issue (parts) of the loan before the end of the year. Let's see if that timeline remains feasible. 2️⃣ Devil is in the details: As with all things, the devil is in the details. Its to be seen what the specific conditions are that make their way into the Memorandum of Understanding 3️⃣ Russian countermeasures: In a first response, Russian Finance Minister Siluanov warned that Russia could take the proceeds generated by Western owned assets located in Russia - however, as of writing no further details have emerged. Also see the published EU legislation here: https://lnkd.in/eXbqGTyH ▶ EU Guidance / FAQs Also expected in the near future, additional guidance / FAQs are to be published. Likely topic to be covered: the 'best effort' obligation. #sanctions #EU #Russia #compliance

As part of the most recent amendments to the Chinese Criminal Law, the newly added Article 219a introduced the crime of commercial espionage - with high fines and lengthy jail terms for trade secrets misappropriation that benefits an overseas business or individual. This IAM article focuses on the first three cases and analyses the reform's importance. Many thanks to these local lawyers: 🔎 “This new provision fills a legislative gap that existed in terms of legal remedies when a trade secret is illegally taken from China to abroad” - Terry LU of Lusheng 🔎“It’s kind of reciprocal to the economic espionage crime under the US Economic Espionage Act of 1996 which controversially is often enforced against Chinese engineers for allegedly stealing trade secrets from the US,” - Jerry Xia of GEN Law Firm’s Shanghai office #TradeSecrets #China #ForeignEspionage #IPtheft #NewProvision

Happy to be interviewed in this IAM article by Maia Edilashvili Biermann. Indeed companies doing business in China need to pay extra attention to this new foreign espionage crime when sending any confidential info outside of China. Employees should be trained/warned for “their personal good” that no information should be shared with people outside of China unless clearly approved. Even for internal cross-border information transmission within a multinational enterprise, strict scrutiny is required especially for external information from their Chinese partners or government authorities. #chinaip #tradesecrets
