I am honored to have been published in this month's issue of the Environmental Law Institute's Environmental Law Reporter! Last November, the Supreme Court heard arguments in Securities and Exchange Commission (SEC) v. Jarkesy. The case centers on whether and with what protections SEC should be able to enforce securities laws through the agency's in-house judges instead of federal courts. With administrative law in a state of flux, the Court's decision has the potential to redefine the enforcement authority of the Environmental Protection Agency and other agencies across the administrative state. In Gathering Storm: SEC v. Jarkesy and Implications for Environmental Enforcement, I evaluate the three Constitutional issues that will be assessed by the Court in their forthcoming decision and identify how EPA may be able to defend its enforcement program in the face of these unprecedented challenges.
