My latest post on what I believe to be landmark cases in military justice. In this one, I highlight a case often used to justify the egregious expansion of military justice jurisdiction (for civilian caseload reasons, not military necessity), when the actual citation was used to LIMIT military jurisdiction. In addition to holding the system accountable through litigation, I often use my fortunate experience, and passion for military legal history, to share the accurate story of American military legal history and the evolution of the law within it to counter the behemoth’s narrative.

An ethos in the Marine Corps is that Marines must have a bias for action. What does that mean? That you’ll take initiative, move with purposeful intention, and make quick decisions without being paralyzed by risk or analysis. It’s an essential warfighting skill. Lawyers often lack a bias for action. They’re slow to move and react. They get bogged down. They fail to communicate with their clients.
