Dear All, Please do not forget to include the tainees in outside practice also, in your debate. Where these trainees are not even provided with the required training (as no culture exist) and now more and more industries are rushing to register themselves to secure an opportunity to have so called "sasti labour". And in the end these companies themselve not even consider them fit to be hired (even when the job is available, they prefer hiring from outside) and throw them like an extra baggage and the process goes on. Respected Inam ul Haque FCA , For the past few days, there has been controversy surrounding your post. I agree with one aspect of your post: the value of money should not be the primary concern if we aim to grow as professionals. However, the post lacks appreciation and praise for the hard work of trainees during the current economic crisis. I have a few questions: How much has the price index increased? Is anyone providing ad hoc allowances to the students? Do we arrange free coaching facilities for these trainees? Does we adjusted the Credit leaves or pay wages for over work? There are numerous questions to consider. While #ICAP does provide minimum stipend rates for trainees, the bylaws typically do not specify a maximum stipend rate. We adhere to the minimum rate defined by ICAP but do not agree to pay a higher rate, even though there is no restriction against it. I strongly urge us to understand the difficulties faced by CA trainees and to create a culture that provides them with their rightful incentives. Protect Your Business from Hidden Gratuity Liabilities: Know the Difference Between Trainees and Apprentices!!!! . . Many employees who have undergone training or apprenticeships are left confused about their eligibility for gratuity under the Payment of Gratuity Act, 1972. Are all trainees excluded from gratuity? How do you differentiate between a "trainee" and an "apprentice"? 👨⚖️ The Judgment 👩⚖️ In Steel Authority of India Limited IISCO Steel Plant vs. Md. Mohiuddin & Ors. (2024 LLR 831), the Calcutta High Court clarified that not all trainees are excluded from gratuity benefits. The court ruled that only those undergoing "apprenticeship training" under a formal contract of apprenticeship as defined in the Apprentices Act, 1961, are exempt from gratuity. Others, even if labelled as trainees, are considered employees under the Payment of Gratuity Act. 🔑 Key Insights for Employers and Employees: Not all trainees are apprentices. A person can only be considered an apprentice if they are undergoing specific training as per a contract under the Apprentices Act. Trainees are employees, too. Trainees not covered by the Apprentices Act are entitled to gratuity under the Payment of Gratuity Act, 1972. No break in service. If a trainee is absorbed into the job without a break post-training, the period of training is counted towards continuous service, making them eligible for gratuity. ✔ Solution for Employers 1. To avoid future compliance issues related to gratuity, it’s essential to clearly differentiate between apprentices and trainees right from the hiring stage. When hiring apprentices, ensure they are employed under a legally recognized Apprenticeship Contract as per the Apprentices Act. This way, their tenure won’t be considered for gratuity calculations. 2. For trainees or employees undergoing training without an Apprentices Act contract, always document their status and training duration transparently in their employment terms. Also, review the employment agreement periodically to confirm that the categorization aligns with applicable labor laws. By taking these steps, employers can effectively manage gratuity liabilities and prevent disputes down the line. Hi All, something in the nature of a PSA recommendation from a disillusioned old bloke who is 30 odd years into his insurance apprenticeship. If you are broking workers compensation insurance in WA I highly recommend that you do, at the very least, a simple mail out to all of your clients with that coverage reminding them of the importance of pre-employment medicals. The new legislation changes are without question going to wipe out a significant number of smaller trades style businesses (and some bigger ones) over the next couple of years, and for the sake of an hours drafting and an annoying mass email (I detest mass emails) you could potentially save your clients from being in that number. Hold strong through June and have a great week. If you are an employer in Western Australia: 1. Before employing anyone get a full medical history from them, signed. 2. Before employing anyone get an independent medical assessment completed at your own expense. 3. Before employing anyone don't just phone their references, get all of the information you can. All of it. Be excellent to each other!
