I’m logging back on this morning feeling refreshed and inspired after a welcome break and change of scene, road tripping and hiking around north Arizona and Utah’s national parks. While I readjust to the British weather after 2.5 weeks in desert heat it seems it’s not just been raining cats and dogs while I was away ☔️ but it's been bucketing down more detailed employment law reform proposals in the form of the Employment Rights Bill… What can you expect? The Bill is described as a fundamental reset of employment law and a rebalance the rights between workers, business and trade unions. When can you expect it? There is lot to digest and to balance, a lot of change, but also some time to plan, feed into public consultations and take stock as some of the more substantive reforms are unlikely to take effect until at least 2026. What should you be focussing on? While I get up to speed on the 150+ pages of the Bill, and we prepare more detailed analysis, there is clear scope for your business to start some strategic planning such as: 1. Undertaking an impact assessment to understand how the proposals will impact your business (including systems and ways of working). 2. Prioritising collation of metrics to understand and assess impacts on your workforce, cost to the business, and the level of business change required to implement and run new BAU processes and to comply. 3. Considering any ‘no regrets’ actions that your business can take now to get you ahead of the curve. 4. Starting to engage key business stakeholders to understand and start to plan for the level of change required. 5. Monitoring progress of the proposals as further information becomes available and consider actively participating in relevant consultation processes. The FTC recently issued a landmark ruling banning non-compete clauses in employment contracts. This is a monumental step for worker rights and innovation in the corporate world. Non-compete agreements have historically restricted employees from pursuing new opportunities within their industries, limiting career growth and suppressing wages. With this ban, we can look forward to a more dynamic job market where talent mobility is encouraged, fostering a culture of innovation and competitive growth.
