Since moving to Dubai, I’ve had countless people, both familiar and strangers, ask me, “How did you figure out the business landscape? How did you manage to expand your operations and build such an incredible team?” It’s a question that comes from curiosity but also from admiration for what Dubai represents to so many entrepreneurs. Haynes Novick Kohn Immigration has a lot of success with federal litigation, especially writs of #mandamus this year for clients seeking #adjustmentofstatus #asylum #provisionalwaivers #naturalization and even #consularprocessing. Most recently Partner Yusuf Ahmad and I settled a case in the Eastern District of Virginia where our client had been waiting nearly a decade to obtain an interview at the asylum office. Federal litigation is often an effective in many circumstances but sometimes there are indeed more efficient and cost effective solutions. For instance, earlier this year, Kailin Wu and I had a client have their naturalization case wrongfully denied, as USCIS erroneously believed that their decades old second degree assault conviction from #Maryland was an #aggravatedfelony barring them from proving #goodmoralcharacter. Commonly, when a naturalization case is believed to be wrongfully denied you must exhaust administrative remedies by filing form N-336 for a new interview, and if the application remains denied, you can file a complaint in federal district court. In this case the legal mistaken was so woefully obvious, and we did not want to burden our client with additional filing and legal fees. Fortunately at our local field office in #Fairfax, there is a responsive and highly intelligent district counsel who immediately rectified the situation when we faxed them a letter regarding the legal mistake. Our happy client soon thereafter had their oath ceremony scheduled and is now a proud #citizen. The above referenced matter was resolved in days and cost our client no additional money. Not every case needs to be a lawsuit to achieve a clients needs. It also demonstrates the importance of working with local counsel to resolve issues that occur at USCIS field offices. #naturalization #federallitigation #mandamus #uscis #citizenship #immigrationlawyers #casevictories #casegranted #litigation #legalrepresentation

Two important cases which Valentina O'Regan has been reporting on are being heard by the HC next week (15 October & 17 October respectively): 1. Pafburn Pty Limited (ACN 003 485 505) & Anor v The Owners – Strata Plan No 84674: the application of proportionately under Part 4 of the Civil Liability Act to Part 4 of the Design & Building Practitioners Act 2020 (NSW); 2. Birketu Pty Ltd ACN 003 831 392 & Anor v Atanaskovic & Ors - whether solicitors of a Partners' unincorporated law firm in proceedings in which they were self-represented solicitor litigations were able to recover costs of their employed solicitors (per the CoA). Dear esteemed colleagues Paralegals and Lawyers, Please mark your calendars for May 9th at 10 am, as it will be a pivotal moment in mine and your legal journey—a motion to dismiss the Law Society's application against me. Today, I have diligently served over 15 individuals to testify, and I eagerly anticipate impeaching each one on the stand. I extend my heartfelt gratitude to the Lawyers whom are professors and who have reached out to me, expressing their support and advocating for the recognition of paralegals in immigration applications and the freedom to express legal opinions. It is encouraging to hear that they have written to the treasurer of the Law Society, urging recognition of our vital role. Despite this, the treasurer has indicated their intent to proceed with the court of appeal dismissal. We shall see how that unfolds. This upcoming motion is one that cannot be overlooked. It is an opportunity to shed light on the systemic issues within the Law Society. From abusive processes to the operation under an expired business name, the revelations promise to be eye-opening. Furthermore, confirmation from the Attorney General's office regarding the absence of exemptions for the Law Society, as well as the lack of documentation supporting certain investigative firms' claims, underscores the urgency of this matter. Caruso is poised to uncover the truth and confront corruption head-on. My fellow Paralegals and Lawyers, Today, I share with you my factum of the anti-SLAPP I filed against the Law Society and the Tribunal. I stand before you resolute that no one will take my rights away. This is still Canada, a nation where freedom of expression is a fundamental right. Witness how a bencher has blatantly abused their office; exposing the corruption within the Law Society's investigation. Observe how the current prosecutor, acting as an investigator, now manipulates the role of a prosecutor. The PAC allowed this prosecutor to submit a report that I haven't even seen. Not a single Paralegal bencher participated in the voting process. See the collusion between the former bencher and the former treasurer, using staff to execute their deceitful schemes. All this turmoil stems from the ambiguity of bylaw 4 regarding immigration matters. I am fighting for the public interest, striving to restore affordability and justice. Yet, the Law Society aims to bankrupt me with baseless proceedings. They refuse to let me summon their witnesses, rushing to conclude this charade. yet they are allowing to have pre hearing conference and every time I request one it gets denied. They want me to keep bringing motions so they can keep awarding the law society. How disgraceful it is that a tribunal member masquerades as staff in emails, and sympathizes with the prosecutor's incompetence, providing them with case law to use against me. The law society has not even raised matters yet the tribunal member is helping them. This is nothing short of a sham hearing. Paralegals, united, we are unstoppable.
