For IR35 purposes, does the small company exemption apply to the recruitment company or the client? The small company exemption applies to the client, as they are responsible for making the status determination, not the fee payer or the PSC. If the client meets the small company exemption, they will not need to complete a status determination and the rules contained in Chapter 8, Part 2 ITEPA 2003 will apply where the PSC is responsible. IR35 has been the topic of discussion recently when speaking with clients due to the recent change in government and how it will effect their clients and contractors. So lets talk about it! 📢 Now the responsibility for determining IR35 status rests on the shoulders of the end client in most cases, but recruiters becoming experts in IR35 can help position them as trusted advisors and builds client loyalty. By staying updated with the latest changes and providing up-to-date information, both contractors and clients see the value of working with you. This also helps streamlines the compliance process.🥳 3R's Back-Office system has a simple IR35 determination process flow that allows the recruiter to initially decide whether a contractor is “inside” or “outside” 🔹 If “outside”, automated email will be sent to the end client asking them to confirm, allowing the end client to upload status determination statements as necessary 🔹 If “inside”, the contractor will be presented with options to be processed as inside IR35, for example using a umbrella company. Taking liability away from you as the recruiter whilst providing you with a record of status determination, but also providing a quick and simple process to stay compliant with legislative changes.
