#ManifestoMonday: Defending Housing Rights in Harare! The ongoing demolitions in Harare expose a critical housing crisis. Families who unknowingly bought land from politically connected land barons are losing their homes overnight. Demolitions alone won’t fix the problem—it’s time for justice, accountability, and action. What We Demand: Accountability for land barons profiting off illegal settlements Compensation for victims facing demolitions A human rights approach to dealing with demolitions, as they leave families homeless Proactive measures from councils to prevent future illegal sales No more empty promises! Let’s protect housing rights and ensure justice for every resident. #ManifestoMonday #JusticeForAll #HousingRights #EndCorruption

"As we face the housing crisis, it's critical to remember that housing is not just a structure—it's a home. And for over 65,000 years, this land has been home to Indigenous communities whose sovereignty was never ceded. At Anika Legal's Housing Justice Forum, we took a moment to reflect on how ongoing dispossession impacts the safety and security of traditional owners today." Watch this clip from our 2024 Housing Justice Forum panel discussion to hear more about how we can acknowledge this history as we work toward a fairer housing system. Can the government prevent homeless people from camping outside in their jurisdiction? 🏕️ The answer isn't straightforward and depends on local laws and recent court decisions. While governments can set regulations for camping in public spaces, they must respect constitutional rights and adhere to legal precedents. For example, some courts have ruled that it's unconstitutional to criminalize homelessness by prohibiting sleeping in public areas when no shelter alternatives exist. ⚖️ This topic touches on public safety, individual rights, and social justice, sparking important discussions within communities and among policymakers. #Homelessness #PublicPolicy #ConstitutionalRights #LegalDebate #CommunityJustice #CGHLaw

JMPD, SAPS and all other law enforcement agencies are not trained nor legally authorised to carry out evictions and demolitions of people’s homes! Section 4 (11) of the PIE Act, which states that “the sheriff must at all times be present during” an “eviction, demolition or removal”, clearly excludes all law enforcement agencies (public or private) from embarking on their own eviction, demolition or removal of people from their homes, with or without a court order, absence the sheriff’s presence and directions. The primary purpose of ection 4 (11) of the PIE Act is to help ensure that evictions from homes are lawfully, orderly and humanely carried out as required by section 26 of the Constitution. Most importantly, any eviction that leads to homelessness can never be deemed to be just and equitable. What befell the residents of Rabie Ridge does not reflect the ethos of South Africa’s Constitutional Democracy. https://lnkd.in/d8CqUQmK
