CPA statement on recent events & the looming constitutional crisis in #SriLanka #Elections The Centre for Policy Alternatives (CPA) notes with grave concern the actions of the President and the Government in response to the Supreme Court’s interim order last week restraining Mr Deshabandu Thennakoon from exercising the powers, functions, and responsibilities of the office of the Inspector General of Police (IGP). This interim order has been met with statements by the Government, including a formal statement in Parliament by the Prime Minister on 27th July explicitly rejecting it, that raises alarm as to whether Sri Lanka is heading towards a constitutional crisis. CPA urges the President to desist from any or all action that raises that prospect. This is against the backdrop of the Election Commission issuing a gazette setting the date of the Presidential Election to be held on 21st September 2024, and it is incumbent on the Government and all stakeholders to adhere to the Constitution and respect the integrity of the election. Any attempt to subvert elections and the rule of law will have significant implications on governance and democracy and setback Sri Lanka’s path towards economic recovery and stability.

THE LEGISLATURE Parliament: Article 79 provides that the Parliament shall consist of the President and two Houses: the Council of States and the House of the People. The implications of having a bicameral Parliament were discussed in detail in the Constituent Assembly and outside; the arguments in favour are (i) ‘Being composed of two parts, they check one another by the mutual privilege of rejecting’ (ii) A second chamber introduces an opportunity for a second thought in important matters; (iii) In a federal setup, a Council of States is necessary to lend voice to the constituent units; (iv) It would provide a check on hasty legislation; (v) Two differently constituted chambers contribute balance to the decisions. (vi) When one chamber is constituted as a permanent body, Parliament exists even when the other chamber has been dissolved for elections, and (vii) As Parliament is a deliberative body in addition to its main role as a legislative body, a group of ‘elders’ not directly elected by the people can provide sober advice. The arguments against are: (i) It is not essential and is a luxury in a developing country; (ii) It stands in the way of speedy law-making, which the country needs; (iii) If the opposition parties have a majority in the Upper House, legislative processes will get stuck; (iv) Uneven representation for the States makes the second chamber similar to the other chamber in terms of proportion of members from the States; and (v) There is no requirement of domicile in the State for a Member to represent a State. Much of the arguments would be theoretical, looking at the Indian experience so far. The government of the day had a majority in the Rajya Sabha only for 29 years since its constitution in 1952. Of the countries with parliaments, 41% are bicameral, and India is in this group.

This article provides more information: https://lnkd.in/dKPmrWfU Three DA Bills with similar intentions were tabled during the previous Parliament but lapsed when it rose for the May elections. They have not yet been revived. This article provides more information: https://lnkd.in/dTjMFxKN The DA's chief whip recently released a media statement announcing her party's intention to revive all three Bills. However, at the time of writing the official status of these Bills is that they lapsed and are therefore no longer in the parliamentary system. This is but one example of the importance of GNU parties liaising to ensure they are on the same page - to avoid sending mixed messages about the same issues.

I have been reading posts about repeated calls from ICAI election contestants, and let me share my experience. Many of us have similar concerns. We receive countless calls and emails (often ignored) not just for ICAI elections but also for general political elections. At times, we even get frustrated and scold the callers. But here’s the thing: without those calls, would we even know who is contesting? Reflecting on this made me realize their importance. I started paying attention to emails and eventually decided to support a candidate. Would I have done so without those calls? Maybe, maybe not. Interestingly, I also noticed that one of my friends decided to vote after multiple calls. Have we read every candidate’s manifesto, even with those reminders? Are we planning to vote? The reality is, we’re all busy and often forget to participate in elections, only to criticize later. Without those reminders, would we even take the effort? Let’s not wait to be reminded. Take some time to understand the candidates, make an informed choice, and most importantly, participate in the ICAI elections. Your vote matters, and it can lead to the change we all want to see.
