DID YOU KNOW ABOUT OUTSIDE BAR TECHNIQUE ??? The high and low values of the bar are compared to those of the previous bar using the OutSide Bar technique. The strategy will enter a position if both the current high and low are higher than they were in the previous cycle. It follows that the old bar can fit "inside" the current one. It is not easily that both the trial court and the High Court would be wrong on the meaning of house trespass. The judgement by the apex court seems to be a hastily delivered one. Before overturning both the trial court and the High Court, the bench was required to go through all the provisions covering trespass in order to derive proper application of the word “house” in construing “house trespass” as coming out through such structure of provisions. Then definitely the illustrations to the provisions were required to be gone through. If the above care had been taken, it would have been seen that the word house has not been confined to buildings for residential purpose only but covers also through explicit words buildings where there is property and related custody of such property. Again one of the illustrations without differentiating between a cargo ship or a passenger ship lays down the offence of house trespass in relation to a ship meaning that where in substance goods, cargo or property is kept; then the same would also come within the meaning of house trespass. A restaurant is a building having property and related custody of property and therefore explicitly comes within the meaning and definition of house trespass provided for under the applicable provision. #supremecourt #judge #court #law #lawyer #counsel #advocate #lawfirm
