ACA to AHP to Price Transparency

After some research, I wanted to share some insights on ACA, AHP, and my thoughts on price transparency and how - when added to other solutions - could help in health care cost reduction.

AHP - Association Health Plans, recently finalized by the Trump administration, allows for individuals, small businesses, sole proprietorships, and the like; to join together into one entity (The Association) essentially creating a large business entity for the purpose of buying power in the health care market. Large employer groups have more buying power because there are so many employees contributing to the risk pool. Because of that, you can take advantage of adjustable rates, plans that are available across state lines, and lower composite rates (one person would have a flat monthly cost, regardless of age).

This isn't something new. PEO's do this and Associations that have formed for other reasons (Realtor's Associations, Rider's Associations) have often purchased a medical plans in the large group arena. In fact, under ERISA 3(5) this association is called a Multiple Employer Welfare Arrangement (MEWA), and this established definition was used to describe and treat the new AHPs.

Cut to - CA Insurance Commissioner, Dave Jones' announcement on how California will treat the AHP. Not his decision, he referred to existing California law prohibiting the formation of any new MEWAs - providing the reasons the law was put into place, and (speculation here) why he might not amend the law. Insolvency is not something anyone wants to deal with. Why is this significant? Because the new AHP law is defined by the ERIA 3(5) under MEWA. Because it's technically a MEWA, the state of CA won't allow new AHPs to form. Of course, that doesn't stop an association forming in Nevada, for example, and taking on nothing but California small business

What's the solution? Is there a need for a solution? Maybe we should be asking, "What is the goal?"

I'm sure we can all agree that having high quality, and truly affordable healthcare for everyone is what we strive for, and these solutions are means to an end. There are pros and cons to all of it, MEWA, AHP, ACA, PPACA, ETC. enough with the acronyms. We get it, depending on our own situations and circumstances, we view all of these differently, and can provide evidence on either side of the spectrum to support our opinions.

Has anything worked in the past? - Yes, and No - Price Transparency

Yes - In the retail market, Price Transparency has shown positive results in reducing costs. Businesses like restaurants, boutique shops, cell phone companies, direct to consumer tech companies (Apple, Microsoft), and cosmetic surgeons - they are now posting their prices online for all to see, and gladly taking reviews. This gives you, the consumer, more power in the driving down costs, and driving up quality.

No- Price transparency hasn't been fully implemented in the health care arena. One hospital may charge $2500 for an emergency appendectomy, and a hospital down the street may charge $30,000 for the same procedure. Many providers could hide behind the copay - the patients would only see a $200 ER copay, not thinking of the real charges. Or a prescription drug that costs you $10, would cost the carrier over $20,000. There is hope, though. UCLA and Los Robles, just to name a few, now have a price estimate page on their websites, where you can see what they typically charge for their services.

According to a recent article by Jacqueline Lapointe, she refers to a Rice University Brief "Healthcare consumers are EXPECTING their experiences with providers to mirror those in the retail space." So how can this statement change the policies? Some carriers are already taking measures. Mario Schlosser, co-founder of Oscar Health, stated in an interview that we should "Fundamentally rethink the way networks should be built, and the way benefits should be structured." By re-thinking our health care, we can look at healthcare providers of all types, and start working with those that offer their prices - so we can analyze the quality, and the pricing, to determine if they are right to do business with.

Doing this on a consumer side - we've seen success. Perhaps doing this from the carrier side, we might show progress towards a truly consumer driven healthcare market, putting the power back into the hands of the people needing it the most, people like you.

This is one of many solutions, of which I felt the most hopeful about.
