Billionaire and Grammy-winning American singer-songwriter and actress Taylor Swift became the target of X users when a series of AI-generated deepfake photos depicting her in sexually explicit and violent scenarios circulated without her consent.
In January 2024, the explicit images remained on X for an extended period, allowing global media to report the news before the platform took action, temporarily restricting search engine results for terms like 'Taylor Swift deepfake' and 'Taylor Swift.' Despite these measures, we know 'All Too Well' that users can easily find such graphic content using alternative search terms, like 'T Swift,' since these images cannot be entirely erased from the internet.
Speculation that Swift's team will take legal action over the deepfakes begs the question of what legal avenues we have as individuals and businesses to pursue to safeguard our reputation as well as privacy? If there is anyone who can put an end to the 'Bad Blood' with AI-generated content, it's Swifties✨.

The alarming deepfake images featuring Swift prompted action from the White House Press Secretary, Karine Jean-Pierre, advocating for legislative measures on the issue. The lax enforcement of existing laws disproportionately affects women and girls.
Homeland Security highlights the heightened vulnerability of women as the primary targets of nonconsensual deepfake pornography, with estimates from journalist and data scientist Karen Hao indicating that at least 95% of deepfakes involve nonconsensual explicit content featuring women.

As the owner of a female-majority team, I naturally exhibit bias in my appalled reaction to the dissemination of deepfake pornography featuring a woman online.
Consequently, I pose the following questions to you, dear reader: Am I overreacting? Swift, being a widely recognised public figure on a global scale, does that automatically entitle her to the same privacy rights as you and I? If a case of deepfake pornography involved your female friend, sister, mother, or even yourself, how would your reaction be shaped?

What are deepfakes?
Deepfakes derive from technology that is manipulated to create fake AI-generated content. The United States Homeland Security describes deepfakes as media that subjects images, video, audio, and text to either, "simulate or alter a specific individual or the representation of that individual."
The 'synthetic media' that is modified through the use of artificial intelligence (AI) has become too realistic to differentiate from fraudulent content. Brian Monarch's YouTube video below, where Arnold Schwarzenegger's face and voice seamlessly replace Judy Garland's in The Wizard of Oz, exemplifies the remarkable realism achievable in synthetic media through AI technology.
Consequently, the misinformation or disinformation spread by deepfakes poses a threat to the targeted individual's reputation, as well as their emotional and financial well-being.

In the era of deepfakes and limited AI regislation, what cybersecurity measures should companies implement to protect their executives and public figures from potential reputational damage caused by malicious AI-generated content?
The civil and criminal legislation in Australia does not penalise the creation and possession of pornographic deepfakes. There are also copyright exceptions specific to data mining or using works for machine learning. Unless legislation is put forward to prosecute offenders and effective tools are developed to identify and alert users of deepfakes, AI will continue to pose a cyber threat to individuals as well as industries.
Considering deepfake content is a global cyber threat with the advancement of AI technology, what role could international collaboration between Australia and the likes of countries, such as the United States of America, play in developing standardised regulations and countermeasures against deepfake threats to ensure a global response to this evolving challenge?
One suggestion for individual users to minimise deepfake content is to change their public social media settings to private. A private profile will limit the user's digital footprint online and the knowledge, as well as access, that public users have to their accounts.
In the online landscape, it is forecasted that these attacks will become easier and more successful. To mitigate this global cyber threat, action will need to be preempted by businesses, and will need collaboration from governments, industries, and society.
