Medical Devices; Exemptions From Premarket Notification: Class II Devices; Clinical Electronic Thermometers; Request for Comments

The FDA has discovered certain class II electronic thermometers will be exempted from premarket notification requirements and is requesting public comments.

Please submit comments by January 2, 2024.


Freedom of Information Act (FOIA) Advisory Committee Meeting

FOIA Advisory Committee is having an upcoming meeting.

The meeting will be on December 7, 2023.

You must register by December 5, 2023 to attend.


Open Meeting of the Internet of Things Advisory Board

The Internet of Things (IOT) Advisory Board will be meeting on the following days:

Tuesday, December 12 and Wednesday, December 13, 2023 from 11 a.m. until 5 p.m.

Both sessions are open to the public.


Medical Devices; Hematology and Pathology Devices; Classification of the Container System for the Processing and Storage of Red Blood Cell Components Under Reduced Oxygen Conditions

The FDA is classifying the processing and storage of red blood cells as Class II because of the safety and effectiveness of the device.

The order became effective on November 9, 2023.


Real-Time Oncology Review; Guidance for Industry; Availability

The FDA is announcing its final guidance “Real-Time Oncology Review (RTOR).”

The objective is to provide recommendations on the submission for NDAs and BLAS with oncological treatments.

The guidance was published on November 8, 2023.


Chairs Rodgers and Latta Announce Hearing on Exploring the Uses of AI for U.S. Communications Networks

The House Energy and Commerce Subcommittee on Communications and Technology will be holding a hearing on November 14th.

Both members released the following statement below:

“In the communications sector, AI could enhance the performance of next-generation networks and vastly improve internet speeds. But with the benefits of AI come potential risks, like enabling cybercriminals to develop potent threats to our critical communications infrastructure. American leadership is vital to ensure the responsible deployment of AI, protect people’s privacy, and unleash the full potential of this technology," said Chairs Rodgers and Johnson. “We look forward to this subcommittee hearing, where members will hear from industry representatives and other stakeholders about how networks are using AI tools, the risks associated with those tools, and how AI technology can be used to improve our communications systems.”

Codecademy ML/AI Engineering Certificate

I am in the process of working towards the Codecademy ML/AI Engineering Certificate program. The program is $350 annually. With the certificate, I plan to combine my AI policy and engineering knowledge when examining healthcare models.

Sen. Dan Sullivan [R-AK] is the latest cosponsor on S.3193.


H.R. 5398 Bill Update

H.R. 5398 was voted favorably by the House Energy and Commerce Subcommittee on Innovation, Data, and Commerce to the full House Energy and Commerce Committee on a vote of 21-0.


H.R. 5950 Bill Update

H.R. 5950 now has bill text.

A few key details about the bill are below:

‘‘(b) PURPOSE.—Grants under subsection (a) shall be used to facilitate quantum information science, technology, and engineering research and development, including by carrying out the following: 

 ‘‘(1) Upgrading or adding research resources to accelerate the development of quantum technologies, including capabilities focused on addressing the roadblocks to implementation, and meeting the materials, advanced materials development, and device needs of the scientific community and the quantum supply chain. 

‘‘(2) Enhancing access to equipment and instrumentation, including at partnering institutions,  by facilitating information sharing, coordination, scheduling, education, and training, including activities that provide meaningful hands-on learning experiences for students, including at community and technical colleges. 

‘‘(3) Enabling professional staff to support the operation and improvement of research resources used for quantum information science, technology, and engineering research and training.

S.3204- A bill to amend Internal Revenue Code of 1986 to streamline and improve the employer reporting process relating to health insurance coverage and to protect dependent privacy.

State Legislation

Houston Mayoral Race Heads to a Runoff Scheduled for December 9th.

U.S. Rep. Sheila Jackson Lee [D-TX-18] and state Senator John Whitmire head to a runoff.

Whitmire was quoted as saying:

“I’m so pumped, I’m so excited for you and for Houston, I wish that I could go to work in the morning,” he said. “Let’s leave here fired up, I’m fired up — I need you fired up.”

Jackson Lee was quoted as saying the following:

“I started this journey around the issue of people — making sure that whatever I said was to make Houston a liveable city, and to make Houston a city that responded to the needs of families and our children,” Jackson Lee said. “I hope that however the outcome is, it will reflect the people bought into a positive agenda that will take this city into the future and that future will be something for everyone.”

Both candidates have deep political experience.


Governor Greg Abbott calls a fourth session for vouchers and border security.

The Texas Governor was quoted as saying:

"...I am immediately calling lawmakers back... to complete their critical work to empower Texas parents to choose the best education pathway for their child while providing billions more in funding for Texas public schools and continuing to boost safety measures in schools."

It is a monumental time in Texas legislative history because both governing bodies have never meet 3 times for special sessions during regular session.

The main point of contention is rural Republicans and Democrats who believe that public schools would lose needed funding over school vouchers.

Rep. Brad Buckley [R-Kileen], Chair of the House Public Education Bill revealed a legislation that would increase the amount of money that school districts would receive per student.
