Byfield Bytes- December Edition

Even though we all feel crawling towards the finish line and a well-earned break, it really does feel like this year has gone in a flash. Fried Frank’s Steve Epstein told Law.com that the legal industry has “never been more dynamic” and we couldn’t agree more.

2024 has seen a fair amount of market consolidation and rebrands, from A&O Shearman’s merger finalisation to Freshfields’ rebrand to the recent announcement of Herbert Smith Freehills merging with New York’s Kramer Levin. On both sides of the pond, the lateral hire market has also remained hot with US firms doubling down on corporate, disputes and finance hires this year, both in the US and the UK. We expect both trends to continue into the new year as the London and New York markets have never felt more closely aligned.

In addition to that, the war of trainee and NQ salaries just keeps heating up. It is becoming increasingly difficult for UK and international firms to match US firms’ rates. Meanwhile, 2024 has sadly also been a year of office closures and restructurings, primarily due to an increasing number of firms leaving Hong Kong and China but also due to firms narrowing down their focus and giving up offices that just aren’t overly profitable.

On the disputes side, 2024 kicked off with the ongoing Post Office Inquiry, which has triggered increasing scrutiny of external legal advisers as well as in-house counsel’s role in handling the private investigations into sub-postmasters some years ago. This comes at a time when the SRA also is looking into ethical conduct in litigation and investigations.

Talking of the SRA, it has been fairly active this year also in cracking down on SLAPPs (see the ongoing coverage of the SDT case into the letters to Dan Neidle in relation to Nadhim Zahawi), and AML compliance. But the regulator has also come under scrutiny and criticism for its role in the Axiom Ince fallout. More on that, and on managing client monies on accounts, is expected next year.

On the transactional front, M&A and IPOs have been picking up this year and they are showing no signs of slowing down. Deal activity should continue and bump law firm profits in the next year.

Finally, 2024 was a year of elections in the US, the UK and France, all having major market implications for the coming year. While the UK government is pushing regulators to relax their stance to attract more investment to the City, the US is set to opt for less regulation but more tariffs. It remains unclear how the markets will react, but the uncertainty and volatility linked to elections has dissipated, which can only be good for business.

On this tentatively positive note, we wish you all happy holidays and we will see you in 2025!

Big questions for January

The new year is a good time to dust down and refresh your communications strategy and playbooks., here are a few things we will be thinking about in 2025:

·With law firm M&A and internal strategic reorganisation activity picking up, what do I need to consider refreshing our communications and ensure that we’re prepared for any potential announcements next year?

·With an SRA crackdown on financial compliance and misconduct, is it worth holding a meeting with our GC/Head of Risk and Compliance, and review all our current crisis scenarios of this kind?

·Many newly-promoted partners will be needing some profile-raising. How comfortable are they with media relations? What are their aims and how can we help them with those? Do they need media training?

·Every new year brings a number of retirements and partner departures. Are our messaging and strategies to tackle those up to date?

·Financial reporting season is on its way – for US firms in January and then UK firms in the Spring. What can we do differently or better in our messaging this year?

Lawyer Quote of the Month

“Perhaps the most transformative change in the profession in recent years has been the advent of free agency among partners and even among certain clients. Partners no longer presumptively stay with their firms for life. Clients, too, switch firm loyalties with increasing frequency. These are today’s market realities, said Brad Karp, chair of Paul Weiss, to Law.com.

Byfield Spotlight

The Byfield team recently came together to reflect on the year about to close and plan for the next.

✨ We kicked off with our senior management team presenting our mid-year accomplishments, celebrating the milestones we've achieved together so far this year.

🤝 We then took part in some team-building activities which tested our creativity and collaborative skills which resulted in the creation of some pretty impressive, and less-than-impressive spaghetti structures.

📣 To top it off, members of our team shared learnings and best practice from key client achievements.

A huge thank you to our partners and clients for being part of this journey with us. We’re excited to build on these successes together as we move into the next chapter.

A heartfelt thank you to everyone who joined us for the Legal PR and Journo Christmas drinks, hosted in collaboration with Giselle Daverat. 🥂

It was a fantastic evening and a wonderful opportunity to celebrate another amazing year with our clients, colleagues, and friends. We hope to see you all again at next year’s gathering! ❄️

Associate Director Bethaney Durkin examines the reputational risks that can arise when potential conflicts or gaps emerge between a firm's values and ESG commitments and its client obligations. 🌍

“Despite increasing challenge from campaign groups, few law firms to date have ‘grasped the nettle’ and addressed the potential conflict between making public ESG commitments that focus on reducing emissions and continuing to act for major oil and gas clients.”

Associate Directors Bethaney Durkin and Liam McCafferty recently shared their insights in Law360 on how major geopolitical events over the past decade are influencing law firms' decisions on where to conduct business. 📰

🗨️“Today, firms must contend with a range of pressures that carry significant reputational and financial implications. These include ongoing conflicts in multiple regions, simmering societal unrest in various countries, and a decline in cross-border collaboration on critical issues like artificial intelligence and climate change.” 🗨️

Senior Account Manager Jessica Hancock shares her insights on potential mergers in 2025, focusing on mid-sized law firms and the factors driving these decisions. She highlights challenges such as the ongoing struggle with organic growth and the need to find solutions for delivering cross-border mandates.

“Amidst these challenges, mid-tier firms must grapple with differentiation. Being “a bit of everything to everyone” is rarely enough to sustain consistent growth in a congested market. Many firms are expanding beyond their traditional turf to emerging legal hubs like Bristol or Leeds, challenging the traditional powerhouses of those cities - but even this approach has limits. Strategic acquisitions—whether to enhance capabilities, secure footholds in new markets, or achieve scale—remain an attractive route to scale up quickly.”

Some Things you might have missed…

Towards the end of November, Meg and Dina were joined by Sean McGuiness, Investment Manager and Senior Legal Counsel at Omni Bridgeway. They discuss how the PACCAR decision is impacting the market and what to expect from this government in the legislation tackling it (when it comes through), controversies around litigation funding such as fees the funders charge, why funding is so important for litigation and the upcoming market trends to watch out for.
