A Milestone in Global AI: The Adoption of the AI Convention
On September 5, 2023, a significant Chapter in the Evolution of Artificial Intelligence Governance was written as the Council of Europe announced the opening for signing of the first legally binding International AI Treaty, known as the AI Convention. This groundbreaking Agreement, adopted in May after extensive negotiations among 57 Countries, aims to address the Human Rights implications of AI Technology while fostering responsible innovation.
A Collaborative Effort
The AI Convention represents a concerted effort by a diverse coalition of Nations, including #FutureOfAI #Europe Members of the European Union, the United States & the United Kingdom. Together, these regions account for over 30% of the world's GDP based on Purchasing Power Parity (PPP), according to the International Monetary Fund (IMF). This significant economic weight highlights the importance of the Treaty in shaping Global Standards for AI Governance. As Britain's Justice Minister, Shabana Mahmood, articulated, this convention is vital for harnessing new technologies without compromising our core values.
Distinction from the EU AI Act
It's important to note that the AI Convention is distinct from the EU's AI Act, which was enforced in early August 2023. While the EU AI Act focuses on Regulatory Measures within the EU Internal Market, the AI Convention serves as an International Framework that invites non-EU countries to collaborate. This broader approach aims to establish a unified global standard for AI Governance, recognising that AI operates across multiple nations and jurisdictions. Without International Standards & Enforcement Mechanisms, efforts to regulate AI could prove ineffective, much like the challenges faced in coordinating internet governance.
Enhancing Human Rights Protection
Under the New Framework, Human Rights, Democracy & The Rule of Law will be further protected from potential Threats posed by AI. The treaty commits signatory countries to collective action to manage AI Products and safeguard the public from misuse. The UK Government has acknowledged that while AI holds the potential for significant benefits - such as boosting productivity and enhancing cancer detection rates - the Treaty also includes essential safeguards against risks, including Misinformation & Biased Data.

The UK Government has expressed its commitment to working with various Regulatory Bodies to implement the Treaty’s requirements effectively. However, the effectiveness of this agreement will depend on how well countries translate its principles into actionable policies.

Nick Emmerson, President of the Law Society of England & Wales, emphasised the importance of this Treaty in upholding fundamental principles and fostering international cooperation. He noted that while this is a promising start, it is only the beginning. The UK is called to take a leading role in shaping future Treaties & International AI Governance Initiatives.

The Government is committed to ensuring that the development of AI aligns with Shared Legal & Ethical Values.
