Welcome to the August 2023 edition of the AI & Partners Newsletter. Our concise monthly newsletter by AI & Partners providing you with up-to-date developments and analyses of the proposed EU Artificial Intelligence Act (the “EU AI Act”).  Another stellar month for legislative and business developments. From the commencement of trilogue discussions voting on the EU AI Act to United Nation’s AI for Good Summit 2023, there has always been something to do in a dynamic, fast-paced world.

What’s the latest with the legislative process?

  • Spain has undertaken the rotating presidency of the EU Council of Ministers, with a prioritisation of digital priorities and reaching a political agreement on the EU AI Act.  In line with Euractiv 's Luca Bertuzzi , in preparation for negotiations with the EU Council, Parliament, and Commission, Spain distributed a document outlining its position on salient points of the Act. These included the definition of AI, classification of high-risk applications, the list of high-risk use cases, and the impact assessment on fundamental rights. Regarding the definition, the presidency accounts for options such as adopting for the Council's text, aligning with the Parliament, or awaiting the OECD's direction. With respect to the classification of high-risk applications, multiple options are considered, including adopting the Parliament's version without the notification of competent authorities or modifying it with binding self-assessment criteria for AI providers. The document also accounts for whether the EU AI Act is the correct place to address concepts such as democracy, the rule of law and sustainability, and whether the term 'deployer' should be introduced to avoid confusion. The discussions set to inform negotiations in the trilogues started last month.
  •   Luca Bertuzzi notes how the Spanish presidency has also distributed the options pertaining to articles on sandboxes and innovation (51-55). The Parliament has made it obligatory for national authorities to implement AI sandboxes, where companies can experiment with new AI applications under the supervision of a competent authority. Notwithstanding, the Council holds this measure as voluntary, with eight countries supporting this approach, while some other countries like the Parliament's approach. The Parliament's position also incorporates providing AI developers that exit a sandbox the presumption of conformity for their systems, but the Spanish presidency highlights some issues with this process, such as losing control over the compliance process and causing negative impact on competition. Other topics of significance include real-world testing conditions and whether to determine the details for regulatory sandboxes through a separateimplementing act.
  • POLITICO 's Pieter Haeck posits that Belgium plans to opt for the incorporation of an agency with technical expertise in algorithms within the European Union during its Council presidency next year. The country acknowledges the requirement for a structure that can objectively analyse algorithms to assist AI governance and rule enforcement. Rather than creating a new agency, Belgium suggests upgrading the European Centre for Algorithmic Transparency (ECAT) in Seville, which currently delivers technical expertise on AI-powered systems for content moderation under the Digital Services Act. Notwithstanding that some EU data protection authorities have already assumed algorithm-surveillance powers, Belgium holds the view that the enforcement of AI governance should take a different approach to circumvent fragmentation. Belgium has also talked about the idea with other EU countries and aims to prioritise it during its Council presidency in January 2024.
  • According to Euractiv 's @Luca Bertuzzi, the EU AI Act Trilogue has made progress, with less controversial aspects passed at the technical level. The parts ready for confirmation at the political level are the obligations of providers and users of high-risk systems, conformity assessment bodies, and technical standards. Provisions supporting innovation and the obligation for a fundamental rights impact assessment remain unconfirmed. Some systems will require third-party conformity assessment by certified auditors, which must be authorised by national authorities. The designation, and its contesting procedures, have been updated. The European Commission's discretion in drafting technical standards has been limited, and consultation with the AI Office and the Advisory Forum is now mandatory. Finally, parliamentarians introduced an obligation for users of high-risk systems to conduct a fundamental rights impact assessment before use, but the Spanish presidency proposes limiting this to public bodies, and making stakeholder consultation merely voluntary.

Conference: Postcard from AI Summit 2023 in London – A time for technological disruption

For the third time, the AI for Good Summit was held, this time in Geneva, attracting a wide participation from people across the AI ecosystem, including start-ups, legislators, international organisation delegates - and more. The event was attended with the standard passion. However, the overriding sense of anticipation was on the main agenda item: how to accelerate the United Nations’ SDGs.  

This was most likely due to the recent array of action-oriented initiatives aimed at promoting #AI to advance health, climate, gender, inclusive prosperity, sustainable infrastructure, and other global development priorities.  

Moreover, the outlook for the community was relatively positive, driven by the sheer scale of innovative products and services – far exceeding those of the much publicised generative #AI applications.
