Overview  

Introduced in 2023 and set to be applicable from September 2025, The EU Data Act is a fundamental regulatory framework for the corporate world. It was designed to boost the EU’s data economy and stimulate a competitive data market. The way to do so is by making data more accessible and usable, encouraging data-driven innovation and increasing data availability. [1] Its implementation is expected to drive innovation and competitiveness in the maritime sector by streamlining data exchanges and fostering the development of advanced digital solutions. 

This regulation recognises the growing significance of data generated by Internet of Things (IoT) devices, which are increasingly integrated into asset-heavy industries, such as maritime operations for real-time data transfer and monitoring purposes. [2] For instance, data collected from connected vessels can be key for improving operational efficiency, safety, and compliance with environmental regulations. 

Fostering Interoperability and Standardisation 

To facilitate effective data sharing, the Data Act also emphasises the importance of standardisation and interoperability among data processing services. [3] By creating interoperable frameworks, it allows data to be shared and jointly processed more easily and efficiently, fostering more innovations and value created for stakeholders.  

What This Means for the Maritime Industry 

With the increasing awareness of how important adopting digitalisation and using data-driven processes is for strategic business purposes, the implementation of the EU Data Act is expected to have a transformative impact on the maritime sector. [4] As the EU Data Act aligns with existing frameworks to facilitate improved data sharing practices, stakeholders are encouraged to adopt these solutions and frameworks at competitive costs.  

However, despite the potential benefits, many small and medium enterprises (SMEs) face significant challenges in transitioning to new data-driven practices. The high costs associated with accessing and integrating relevant data for innovation have been a concern for SMEs, limiting their competitive participation in the market. [5]

A further challenge is integrating compliance measures into existing product development and operational protocols. This is particularly problematic in the maritime sector, where legacy systems often require substantial updates to accommodate modern interfaces. Data from original equipment manufacturers (OEMs) is frequently stored in silos and utilises diverse data protocols, adding complexity to the task of extracting value from these sources. [6]

Future Outlook 

The maritime industry is on the brink of significant transformation driven by the adoption of advanced data analytics and digital technologies, with 93% of Norwegian decision makers expecting a phase of rapid digital transformation in the maritime industry in coming years. [7]

The EU Data Act represents a significant step towards transforming the maritime industry into a data-driven sector, with implications for operational practices, regulatory compliance, and market dynamics. As organisations prepare to navigate the complexities of this new legal landscape, the effective governance of data sharing will be critical to harnessing its benefits while mitigating associated risks. [8]
